To think items in a sealed box where you cannot see the items should be able to be returned online ??

I have already posted under legal , but another mumsnetter said I should post here .

I bought some swimwear for my 14 year old daughter from a company called modibodi.

Each of the items are delivered in individual sealed card evnvelopes - see photo. You cannot see the actual item at all , the fabric, the colour or the size !!!

The company I bought them from is saying I cannot return them because I have now opened them . They said that this is a term and condition when I place the order . I don’t think this correct ?

aibu to think I should be able to return these items under distance selling act ?

any advice gratefully received

Would you want to receive period pants in any kind of packaging which had been returned to the seller opened with no idea what the previous owner had done with them after opening?

Whether I'd want to or not isn't relevant, the fact is, swimwear and underwear can be returned and is subsequently re-sold

I'd be tempted to return under 'faulty/not fit for purpose'. If they don't fit, they aren't fit for purpose.

Eitherway, I'd email them and ask them to resolve it.

Sure they have to tell you clearly the product must be unopened and in the original condition before you are in a position to open it? Otherwise its very unfair on the consumer.

only on the returns page , which I stupidly didn’t look at ! No where other than that

No, they have to abide by the laws of the country they've put them on the market of.

The only exception is if you go on an American site etc but order from overseas. If it's a UK site or aimed at UK then you're OK.
