to ask for a refund on this dress?

I bought a dress last year. It wasn't cheap at £120. I've only worn it 3 or 4 times and the fabric has ripped along the seam. I sewed it up once but it reoccurred.
I've bought from the shop several times.
It was in a sale, but there was no fault when I bought it.
I've taken it into the shop, but the manageress wasn't in, so I left it with my phone number.
AIBU to expect a refund or credit note? And would you expect a full refund?

can I also add that I haven't split it by wearing a size that's too small - it's pretty baggy.

BodenCardiganNot · 21/06/2022 10:59

When last year did you buy it? I think the fact that you sewed it up yourself may also be an issue.

IbizaToTheNorfolkBroads · 21/06/2022 11:01

I agree that’s pretty shoddy quality, but I think you probably lost your credibility to complain when you sewed it yourself.

MaMaLa321 · 21/06/2022 11:02

towards the end of Summer. So the weather changed, and I only started wearing it this year.
I'm genuinely unsure about where I stand, but surely a dress that splits so soon isn't fit for purpose?

Should have returned it as soon as it split. Returning a year later is ridiculous 🙄

BodenCardiganNot · 21/06/2022 11:03

So around last August? So you had it almost a year?

MaMaLa321 · 21/06/2022 11:04

no - it split recently, when I started wearing it this year I wore it once last year, then the weather changed.

OP posts:
dudsville · 21/06/2022 11:04

I think it depends on the shop. Boden would be most likely to refund but a lot of shops wouldn't. All you can do is present your case and ask.

HSKAT · 21/06/2022 11:04

They won't accept it now that you've touched it yourself.
It was a year ago

MaMaLa321 · 21/06/2022 11:05

I don't know what is difficult to understand about buying a Summer dress in the sales, wearing it once. Then the weather changes. Then I start wearing it in this year's hot weather.

Lockheart · 21/06/2022 11:05

I don't disagree with you, but I don't think you'll get very far. You've had the dress for most of a year, and the shop only has your word for it that you've only worn it 3 or 4 times in all that time. I wouldn't expect a full refund. If they happened to have one to exchange that would be a good compromise, but I would probably only expect a token amount of store credit.

Seraphinesupport · 21/06/2022 11:22

you wont get a refund or credit note a year after buying the dress, especially as they don't know how many times you have worn it. you could say once or twice but in fact its had weekly use or been stored wrong. If they do anything then ill be shocked at the good customer service. most they are likely to offer is a repair of the seam if possible

luxxlisbon · 21/06/2022 11:27

I don’t want this to come across wrong but are you sure the dress fits your shape?
You say it ripped along the seam, but then you fixed the seam yourself by restitching it but then the same thing happened again. So the second time it was your seam that came apart.

Sweetmotherofallthatisholyabov · 21/06/2022 11:29

Do you have your receipt?

MandyMotherOfBrian · 21/06/2022 11:30

As it’s after six months since purchase (doesn’t matter that you only recently used it) the Consumer Rights Act states that you have to prove it was faulty when you purchased it. In addition, even if it was prior to six months since purchase, the fact you have attempted repair yourself is reason enough for the retailer to not offer repair or refund as it means you’ve de facto ‘accepted’ the item. But you might get lucky if they have very good customer service and they may offer you something.

Mariposa80 · 21/06/2022 11:30

It's not clear from your post - has the seam come undone, or has the fabric actually ripped at the seam?

TheYearOfSmallThings · 21/06/2022 11:31

Honestly I wouldn't return it after a year and several wears. Some shops would refund or offer store credit as a generous gesture of goodwill but...I really wouldn't have the brass neck to ask.

MissMaple82 · 21/06/2022 11:32

A full refund, no! Also depends on the shops policy

SandyWedges · 21/06/2022 11:32

I think as they have no way of knowing how many times you've managed to wear it in a year and you've attempted a repair yourself rather than return it straight away then anything they do offer you will be a goodwill gesture and not to be expected.

MaMaLa321 · 21/06/2022 11:34

thanks all - I'll see what she comes back with.
No, no receipt, but I do go in there a lot and buy stuff.
The fabric ripped along the seam. No problem with the seam.
I don't think it can be the fit, as it's baggy, and not fitted at all.

It's useful to have got feedback on this.

Do you know why your repair also failed?

Regularsizedrudy · 21/06/2022 11:39

It’s been a year. It’s irrelevant that you only just started wearing it.

MaMaLa321 · 21/06/2022 11:39

because the fault was with the fabric, and it only split along a parallel line again.

OP posts:
fruitbrewhaha · 21/06/2022 11:40

Do the seem fail, the stitching? or did the fabric fail and pull out of the stitching? Have you got a phot you can put up?

FemmeNatal · 21/06/2022 11:40

MaMaLa321 · 21/06/2022 11:39

because the fault was with the fabric, and it only split along a parallel line again.

Then that sounds like a fault that they should refund for. I hope you get your money back.
