To ask about domestic violence charges?

Hi all, I have name changed and I am posting for traffic.

Long story short:

  • some close family members have a 25 year history of domestic violence.
  • the abuser has been kept in a cell over night by the police before - many times.
  • charges have never been pressed.
  • this time the victim is deciding to go ahead with the prosecution.
-the abuser is being kept in a cell over night but will probably be let out tomorrow.

What tends to happen in this situation?
How long will it take to go to court?
Will the police have to decide if there is enough evidence first?
What type of sentence could the perpetrator receive?

I'm sorry if this is the wrong place, I can't find clear answers on Google.

There are so many factors.
If the incident was very serious the Police may seek a charge within 24 hrs of arrest and could remand to court or charge but bail with conditions.
The Police may decide they need to make more enquiries so the person could be bailed with conditions or ' released under investigation'.
If the victim does not want to press charges and there is no corroborating evidence, then it may be decided that no further action is taken.
Not that helpful but each case is different so v difficult to say

If there is a charge again difficult to say how long it will take to get to court.
Depends if offender pleads guilty or if it foes to trial.

The police were asking the victim wanted to prosecute and they decided yes.

The victim has never been hospitalised from the incidents. But the abuser has broken the victims property in their shared home (the abuser fully owns the house)

The abuser has an alcohol/drug problem too.

Its all just a mess.

I guess the reason Google doesn't have many answers is because each case is different.

Yes that's the thing so many factors. It's a positive that your relative wants to press charges. I hope they get all the help they need

They would likely ask if the victim would support a prosecution i.e. make a statement and give evidence.

The victim won’t make the decision to press charges, that decision will be made by the CPS.

The police might apply for interim intervention order to stop them approaching victim. Does your relative have children? I would recommend having a look at woman's aid website if in uk.

Hi, I spoke to the victim and she is making a statement tomorrow, the police are gonna help the victim leave and find somewhere to stay.

Her children are both adults and in a different cities.
