Trying to return item of clothing

I bought a jumpsuit online on 24th May. The shop was having a '20% off everything' event so I received a discount. It's too big so I just tried to return it. Shop policy is 30 day return for full price items or 14 days for sale items. The jumpsuit is not in the sale and is still full price both in-store and online.

The sales assistant said it's out if its return period. But I disagree. I think I can be refunded what I paid for it. The manager wasn't available at that point so I've said I'll pop back later.

I'm not angry or anything but I would value other's opinions before I go back!

I've never had an issue returning items at this shop before, full price or otherwise.

I would agree with your rationale OP. If they were having a "20% off everything" event then I would assume it wasn't technically in the sale as it applies to all stock in the store.

So I would assume I had 30 days.
But I can also see it's quite ambiguous and imagine they're taking it as everything sold in that promotion was on sale.

The point of the 14 day thing is that Sale items are going to be discontinued. The jumpsuit is current stock so reasonable to expect the longer returns policy.

YABU. It's a SALE. '20% off everything' is a SALE. You are trying to return it outside of the 14 days allowed, therefore you don't have a case.

Thank you for your replies. The 20% reduction was applied automatically at the point of checkout so I had no choice but to have the discount. If that makes sense!

That's fair enough, but it's still a sale.

Is there any reason why you waited almost 3 weeks to take it back? Did you not try it on til today or something? I would personally have tried it on in the store, or when I got home at least. (Definitely on the same day anyway.) And then returned it within a few days...

@PurpleButterflyWings this shop have very regular 20% off promotions. Sometimes it's on certain things, eg shoes and accessories and sometimes it includes everything. This was a 20% off over a particular timescale promotion. But I take your point.

Like you'd have said no if you had the choice!

it was on sale, just because everything was on sale, doesn't make it a non sale item!

however, I'd argue the point that it's still current stock, so no reason to refuse a refund.

I just found the promotional email I received from them (I'm on the mailing list). The small print says the discount applies to full price items only. So by their own definition, it was a full price item which they decided to discount as a promotional offer.

I'm off to try again now!

You say you bought online. This gives you additional rights (for future reference if you are outside the 14 days from when you actually received the item).

*Online, mail and telephone order customers have the right to cancel their order for a limited time even if the goods are not faulty. Sales of this kind are known as ‘distance selling’.

You must offer a refund to customers if they’ve told you within 14 days of receiving their goods that they want to cancel. They have another 14 days to return the goods once they’ve told you.

You must refund the customer within 14 days of receiving the goods back. They do not have to provide a reason.*

The sales policy I would interpret as clearance sale items, end of season etc. 20 percent is more of a promotional offer then actually sale on this particular item.
you should be entitled to the return in my eyes !

Didn't realise you had bought it online. Missed that bit sorry!!! When you said 'sales assistant said I can't return it' I just assumed 'shop!'

Anyway, I still don't think you'll be able to return it. Can't hurt to try though.

Anyway...they refunded me! Manager was delightful and said it's a glitch in their system.

As someone who worked clothing retail, my understanding is that "promotion" is not the same as "sale". A promotion is a temporary price reduction. Sale goods don't go back up in price.

I disagree with others - that isn’t a sale. It’s a special offer as it hasn’t been permanently reduced.

I suspect the 20% off wouldn’t have even applied to sale items.

It’s 14 days from the date she took delivery.
