Cake maker refusing to make my cake!

Unless I pay £15 more than o originally agreed

I paid a £15 nonrefundable deposit and now she wants another £15 on top of the £50 I was due to pay for the Cake so a total of £80 instead of the £65 I was going to pay in total

Am I being unreasonable to think this is really unfair? She says this is due to the increase in cost of living for example petrol prices and the price of ingredients

Thing is though I paid the £15 which is nonrefundable. So if I don't pay the extra I lose my money

Have you got anything in writing that states the agreed price? If so then you are entitled to a refund as she is the one changing what was agreed originally.

Of course it's refundable if she breaks the contract. Tell her you'll see her in Small Claims.

Did you tick/sign any terms or conditions? How long ago did you make the booking? Do you have the choice of cancelling the booking and getting your money back?

The cost of living hasn't risen that much in 2 weeks I would absolutely be cross and refusing to pay the extra in your shoes.

Although I can also see your dilemma that she won't give you the cake, if she refuses I would be leaving a factual but frustrated review.

Bottom line, she's taking the piss.

That is absolutely ridiculous. Presumably you have the original quote in writing? Just say that was the price agreed and quoted and that is the price you will be paying.

Is it definitely not a misunderstanding, just with the deposit and the additional being asked for being the same, maybe something got misunderstood a,on the way.

But failing that, cake maker is being very unreasonable. If they really cannot make the cake for the agreed price the very least they need to do is refund you the deposit as it is then cancelling the transaction not you.

Of course you're not the one breaking the contract. She's changed the price so it's her that's broke the contract.

You aren’t cancelling. She is the one who is in breach of contract. Were you given a definitive price, not just an estimate?

Tell her

"A quote is legally binding. It cannot be changed post agreement. If you cannot provide the work at the legally binding quoted price then you are the one pulling out of the contract and must refund my deposit.

You can either agree to the quote you gave me or you can refund the deposit. If you refuse to make the cake at the quoted price and refuse to refund my deposit then I will be left with no choice but to warn others of your unethical business practices."

Is the cake ready to collect? Is it very personalised so unlikely able to sell? It's definitely ridiculous to try and up the price 2 weeks after it was agreed - if you'd bought it 3 months in advance discussing a price increase (before production) might've been reasonable but certainly not at this stage. I'd say the situation is actually in your favour - if you refuse to take it then the baker is potentially out the cost of time/ingredients as they may be unable to sell it on.

I'd stick my ground, say you're happy to pay the outstanding £65 but that's it. If she won't give you the cake for that then leave a simple but honest review about previous cakes then this experience, stick to the facts. Then go down to your local supermarket and look at what they have to offer or even a different local bakery if you have time. I'm not sure where you legally stand re getting the £15 back if she won't honour the original price but I'm sure others will.
