Inheritance split - how to split when siblings have different numbers of children

Divorced parent died - two married sons in will, one has 3 children and one has 2. What do you feel is the fairest way for the estate to be split? Lawyer thought straight 50/50 between the two sons. Son with 3 children thinks 55/45 in his favour is fairer as he has more children. AIBU to think that this is unfair on the other son? Just interested in views, thanks.

It should be split per number of siblings not number of grandchildren. Siblings then decide how to split amongst their own children

Doesn't the will say how it should be split?

If not, I'd say 50/50, the money is going to the two sons, not their children.

Personally I think 50/50 between the sons is fair. Or if he'd wanted to leave some to the kids he could have done 33.33% to each son and the rest to be split between the grandchildren.

Absolutely 50/50. The person had two children. How many children they then had is irrelevant.

My dad once asked me if they should give DH and I two thirds and my sister one third, on the basis that when I got married, they gained a third child. It was nice of him but absolutely not!

When you decide the size of your family you know how your resources will be split between them, both in your life and death. The father had two and wanted his resources split 50:50.

One son chose two and again a 50:50 split of his.

Other son chose three and chose 33:33:33 when doing so.

50/50 between the 2 sons. However many children each one chose to have is up to them.

I would carry that split forward even if something had happened to the sons and the money was going directly to the next generation.

Well he would say that! The parent who died however, had two children and presumably wanted to treat them the same.
