Neighbors drain pipe flooding my garden

Neighbors have a 10m x 4 m extension on back of their property, the guttering for this extension is flooding our garden everytime it rains, as he's removed the downpipe to fit a new fence... 6 months ago so clearly they have no intentions of replacing... everytime it rains water now gushes off the fence 8/9ft high and primarily in to our garden... I now have a hugely waterlogged border!!

What can we do about this if they refuse to fix the problem? Is this legal?! Which authority do you speak to about this?

Extension was there before we moved in but surely sufficient drainage is a must?!

The law (common law) requires that you use your property or land in a way that does not increase the risk of flooding to a neighbouring property. If you do carry out acts on your property that results in flooding to other people’s property, you may face a civil action.

Since this is in the USA I suggest you check local State Law there.

Can't channel it on to theirs due to where he's placed the pipe - directly below the hole that the pipe would connect to!

They aren't the easiest people so I can't imagine partner is going to have much luck asking them to sort it. Hence I want to go prepared!

Have you spoken to them ? If the refuse id just add a length of pipe directing it onto their garden.

Not yet, I just want to be prepared as I have a hunch they'll say tough, not our problem. The gutter is attached to the rest of their extension so I imagine they'd just remove whatever I put up..
I know the council services are stretched and noise complaints for example take ages to go through...so I just wondered which department we'd approach

My ex neighbours let their down pipe block which not only flooded my garden, but my cellar too which I was using as an office.

They refused to do anything about it and I had to resort to a solicitor's letter to them.

They screamed and yelled at me when they got the letter, but fixed the blockage whilst shouting abuse.

You may have to pay for a solicitor to remind them of the law.

You could approach the planning department. They'd have planning enforcement officers who would be able to advise you of the correct process. Was there a planning application (you can check the planning portal) as this should have the plans for the extension listed.
