Is this a scam?

Posting here for traffic. My husband dropped into conversation this afternoon that he is due a refund of £865 due to a tax rebate through a claim company called Family Finance Plus. I’d received a text that morning from the same company, suggesting I could be a tax rebate and to reply with a convenient time for them to call me back. I deleted it as assumed it was a scam. I pay tax via my employer on PAYE. My husband does too. Neither of us are self employed.
when I asked about the company he said they contacted him via email and he responded. He is step 3 into the 5 step process. Step5 is receiving the money into his account. I was immediately suspicious and asked what details he had given out. He has sent them a photo of his passport and last 3 months of payslips. He hasn’t given them any bank details.

I went on to register with action fraud to report it, but then found the company online. I called them and they seemed a legitimate company. The lady said they obtain details via other marketing referrals or by previous clients. My husband had given them my name and number hence the text this morning. The company is registered as HAP communications on companies house. I feel satisfied now that he hasn’t sent his details on to a Nigerian call centre who will be taking a large loan out in his name!
However, how would my husband be due £865 (this is minus their 30% fee!). If he pays via his salary, wouldn’t it be correct? How common is it to be overpaid in this instance? I looked at how you do this ourselves via HMRC to avoid the fee, but it means filling out a self assessment form. I thought this was only done if self employed??
I do file for rebates for professional subscriptions, uniform laundering costs and working from home myself via government gateway, but how common is it to pay too much tax via your employer??

I am hoping others may have more knowledge than I do 🙂

You don't get 100% if you've signed a valid form to get it paid to an agent. That's not how it works, the agent gets the money and deducts the commission

If you claim directly from HMRC you get 100%

Yes, I thought that your tax would be correct if paid via your employer, assuming your tax code was correct. This is why I asked on here, but seems I am wrong. I’ve claimed for preofessional subscriptions, marriage allowance (when I was in full time study), uniform and working from home. I went back 3 years and did get a cheque from them, but then in subsequent tax years they just adjusted my tax code. I’ve never applied for a tax rebate as never questioned my tax being wrong. So you can fill in a self assessment even if you pay all of your contributions through your employer. I never knew this 👍

I have read the terms and conditions and it says that they take 33% of the fee. In the message to him (step 2) they have said he is due £865. This is the figure after their cut. They have asked for him to complete step 3 which will enable them to process the refund and pay him within 3 weeks.

he was contacted on Friday , so 5 days ago. The contract says he can cancel within the 14 days ‘cooling off period’, but then it contradicts itself by saying if an offer has been made the fee is still payable 🤷‍♀️ I can’t see anywhere about any future commitments/ deed entitlements. I’ve told him to call them tomorrow and cancel it and follow it up with an email, but fear he may already be committed to the process 🤦‍♀️

he hasn’t given them any of my details apart from name and phone number.

DH just phones HMRC directly and they tell him if he’s owed anything and what to do. Why go through a third party?

You're quite right, IcedOatLatte and I made a mistake there
I read it as the company having suggested the amount due, but see now it was the DH - and as you say, he may have misunderstood

You don't need to do a self assessment return to work out if you are due a rebate, HMRC do it automatically between April and October each year, log onto your gateway account and you can see for each year, 21/22 probably hasn't be calculated yet though as they have until October.

Get your DH to log onto his gateway account/ set one up and if he is due a rebate it will say on there.

Well, yes, that's exactly the point, in this case an agent is being used so the taxpayer won't get 100%
