I sent an item to buyer (shoes) on Monday They have received them and have today requested refund sending pics of the leather split away from the sole

They were undamaged when I posted them.

YANBU to dispute the refund, as they were sent in the condition advertised? Looks like the buyer has put them on and they have subsequently split. There was no indication to me this might happen and were sold in good faith.

YABU - you should issue the refund accept the loss and tell the buyer to bin the item (clearly they are not trying to scam as they look completely broken now).

Thanks!

Yes u should. Tough but happens

Are you absolutely sure they're the shoes you sent?

TriTrey · 30/03/2022 19:49

Advise them to return the item for a refund - even if you dispute, Ebay will always side with the buyer.

I'd definitely get them to return. They might have swapped yours for a old pair they had.

Thighdentitycrisis · 30/03/2022 21:52

The photos sent definitely looks like the item I sent

Thanks everyone I agree with the consensus- just pissed they broke the shoes ☹️

I used to sell camera lenses on Ebay for 10+ years with zero issues, then the past few years I noticed I was getting an increasing amount of returns - I realised they were using it as a free rental service, buying the lens, using it for a week or so, then making up a reason to return.

It meant I couldn't re-sell them as brand new because the box had been opened, and often they'd have scuffs etc. So I lost 30-40%.

I had to cancel my Ebay account in the end, Ebay always took the buyers side and were so unhelpful. Amazon is just as bad!

I don't use ebay any longer because they don't follow European consumer law rules.

I sold 3 pairs of second hand running leggings in good condition (2 x Stella McCartney and 1 Nike) in a job lot for £30 and had a no returns policy. Didn't stop the buyer complaining that one of the pairs had a loose thread and she wanted to return that item only. A loose thread that you could just have cut off! I disputed it and ebay sided with her and refunded her. She showed she had posted the items back to me but either didn't post them or sent them to the wrong address as they never arrived. All for the sake of £10 for a pair of leggings which cost over £100 new...

Then again, as a buyer I've noticed that sellers can change the date for delivery AFTER you've purchased and goods I needed urgently were taking weeks to arrive. And its really hard to leave negative feedback now as sellers dispute it and ebay sides with them if they were business sellers as they want to keep their business. One business seller sent me their ebay response about me and it was really rude and clearly written by someone who had no understanding of UK consumer law.

Compared to Amazon, ebay's delivery service is poor and it was becoming a bit of a lottery as to whether I'd actually receive goods or not. It seems to be a bit of a haven for scammers at the moment.

This is a classic eBay scam. You send an item to a buyer, they have a fake replica item with damage they claim is the real one with photos. They send back the replica for a full refund and keep the item.

Were the shoes you sold by any chance designer/expensive? There's a lot of scams on eBay. It's hard to know what is legitimate anymore.

Just to add, I had a problem with an eBay buyer (one of many sadly). He purchased an immaculate iPhone from me, which was fully charged, factory reset, in original box with ear buds and charger (neither never used). He claimed on receipt that the battery was damaged, returned it and received an instant refund (including insured postage) from eBay. The problem is, he returned a completely different, battered phone, minus all packaging. Of course, he was running a scam, but despite being reported by other sellers and receiving neutral feedback (since the eBay buyer is always right!) he’d been allowed to keep purchasing. I had it checked and it had been submerged in water, non-functioning and totally worthless. I had proof that it wasn’t the same phone (different carrier, PAC code etc.). I contacted eBay by phone and they said, wait for it, “the buyer doesn’t have to return the item they bought”. So the buyer doesn’t even have to return those exact shoes, I’m afraid. Yes, eBay actively supports fraud! I’m just off now to buy a Monet, claim it’s not as described and sending a paper clip back for a full refund…
