To demand to be paid asap

I left my previous job a month and a half ago and when I got my final paycheque, they hadn't paid me for my outstanding annual leave. The company policy is to pay leavers for any outstanding leave and I was entitled to 13 untaken days that I had acrued.

It's been almost three weeks since I flagged it and they've gone silent on me. My line manager there is also ignoring my emails. What's a reasonable amount of time to give them to pay up and where do I stand legally here/what are my rights? The company is notorious for just ignoring stuff like this hoping people will just go away.

Unlawful deduction of earnings I would have thought.

Send a recorded letter to say if you haven't received the outstanding amount by 2 weeks* from the date of the letter you will take them to tribunal for unlawful deduction of earnings.
(*Check the tribunal deadlines- you might need to act quicker than this.)

Hello OP, I work for a trade union. Were you getting statutory minimum annual leave (5.6 weeks per year / 28 days based on a five day week), or were you contractually entitled to more? Basically they are obliged to pay you a proportion of the statutory minimum, and if your contract says so, they might have to pay you more.

The limit for most tribunal claims is three months minus one day from the date of the event/problem and this is the case here.

You need to contact your union, or ACAS.

Thank you for replying. I am a union member but have recently left my union group because I don't work there any more.

I was entitled to 28 days per year. In the holiday year, I had taken 10 days holiday and had acrued 14 days that I didn't take. I work full time hours, 5 days a week.

If you're still paying your subs then someone should still be able to help you but you'll need to contact their central offices to find out who, I should think. Best do this sooner than later.
