Do they have to give him the day off?

I am having a medical procedure with sedation tomorrow and the letter says I have to have someone with me for 12 hours after to make sure I'm safe. My husband is the only option.

We had a week and a half notice, he told his manager as soon as we knew and asked for annual leave. His manager hasn't said no, but also hasn't said yes.

Am I right in thinking they have to him give the day off, like if your child was sick?

They don't have to give him the day off, but they haven't said no yet. Get him to chase it up.

They don’t “have” to do anything, why doesn’t he ask his manager again if it’s ok?

ChessieFL · 17/02/2022 08:55

I don’t think they HAVE to, no. There is a legal right to (unpaid) emergency leave for dependants which is what you would be entitled to if your child was ill, but I don’t think this would count as you’ve had notice.

I think it will depend on his annual leave policy and whether the business can support him not being in that day.

No, of course they don't have to give him the day off.

AllOfUsAreDead · 17/02/2022 08:58

Why hasn't he chased this before now? He should have chased it, now he's left it this late they might say no. Hope they don't.

NeverTouchWarmPants · 17/02/2022 08:59

No they don't have to but hopefully they will. Hope it all goes well for you

thisplaceisweird · 17/02/2022 08:59

Of course they don't. They should, but they don't have to.

WhatTheWhoTheWhatThe · 17/02/2022 09:01

If they haven’t said no it’s probably OK but they may have forgotten in which case him not chasing up until the day before could make it a problem. Why has he just left it without getting confirmation?

Kickers567 · 17/02/2022 09:04

Okay, thanks, yeah he is chasing it up, will stop telling him that they have to, and tell him to suck up and offer to do a weekend shift or something instead, rather than just like I was thinking "he already gave as much notice as possible so it's their fault they haven't arranged cover"

Lol silly me.

Hope all goes well with your procedure OP.

Kickers567 · 17/02/2022 09:05

He has chased it up a few time and been told they are "looking into it."

Can he swap with someone? Sort it himself then offer it to management as a fait au complit?

WhatTheWhoTheWhatThe · 17/02/2022 09:13

Well they’re being unnecessarily difficult then but yeah probably best if he offers to do an extra shift elsewhere instead.

Hope all goes well

Kickers567 · 17/02/2022 09:42

Thanks for the good wishes. :)
