To forward all bank charges to my bosses when they pay me late?

Have worked in current nanny job for 15 months

Have been paid on time once (last month) after having a pretty seriouse converstaion about it, and me making it quite clear its not fair and im NOT happy... and that they HAVE to pay me the RIGHT amount, which should = the amount on my pay slip on my pay day.

Well last month i was paid on time . (the previouse 14 months i was apid a total of 146 fays late )

Anyway today its the last day of the month... I have not been paid...

and im seriosuly considering moving every penny out of the account and charging them all assoiated bank charges just cause im really pissed off about it now.

Is this fair?

Also do i tell them i plan to bill them my charges?

Or just have another coloumn in the nanny diary
Expenses / mileage / bank charges.

in EVERY other way they are perfect employers...

its my "perfect job" exactly the hours i want to work AND i live just 3 minutes round the corner so it really is perfect. I can do what i like with the children etc and am truley very happy there. I have 100% back up from the parents at all times and have never been over ruled at all. I also get on very very wel with my bosses

I dont think leaving would be beneificial for either of us (I keep an eye out for jobs for a nanny friend who doenst have internet access and can honestly say there has not been 1 job i would even consider applying for since ive been looking from May this year )

Have thought about the 'not going into work idea' (in fact so many people have suggested it)

BUT i honestly think it is a very unproffesional way to behave and very childish... also if i dont go to work, surely they can refuse to pay me? as i havent worked, and i cant afford to be payed less next month.

Yes its against my rights or whatever but ultimatley there is nothing i can actually do about it (have had these discussion with ACAS and the legal section on my nanny insurance several times)

Only re-did my contract last month... after all out long 'discussion' and i hoenstly thought they got the message that paying me late was not acceptable and that i am not happy for it to continue.

Texted by bosses to tell them i havent been paid today.... was told "money left our account of 28th" so at the moment its in 'bank land' BUT that is not the point;
it should be in MY bank account now as its MY MONEY!

Im gonna ask them to get it set up to leave their account a few days earlier i think.... and £ does spend a VERY long time in 'bankland' between leaving their account and entering mine, often as long as week , but that is not my problem, or at least it shouldnt be.

Today is NOT a bank holiday so IMO there are no excuses for money not being there today either

No excuse then, they have to make sure you get the money.

The company I work for says in contracts that they will pay at end of month, normally this means they process payment on 28th - however if the 28th is w/e or b/h they process the working day before (and incidentally paid December salary before christmas to ensure everyone got it when most needed!)

I agree the onus is on your employer to ensure you get money on agreed day - not to pay on certain day regardless of when you then will get it....

Maybe they are a little thick and don't realise how long banks take to mess about... I've got some vague recollection that the banks are shortly to speed all this up - can't remember details and doesn't help you much right now though.....

I'm a CM and stopped Internet banking for precisely this reason, it could take up to a week depending on the bank it was coming from.

I now ask for a check on the 28th, or cash on the 1st. It works much better.

Could they pay you that way?

Quite simply... it 2008 (just about)

we BOTH have internet banking.... every hour the bank is open i am with THEIR children... (yes i could take them on an axciting trip to the bank but IMO the park / tumble tots / swimming etc is much more fun)
(being a nanny i dont get a luinch hour either)

I work long enough hours as it is... 7.30 - 6, and i am quite simply NOT prepared to pay £1 to park and visit bank in my time, to pay in a cheque which will then take ages to clear anyway!

so no, i will not take MY time to go to the bank.... i do EVERYTHING online that is possible!

whilst i do see it could be a good idea i wont do it on principle...

also i have it in my contract that they will pay me straight into my bank account so IMO thats excatly what they should do!

it was just a idea, and I can understand you getting angry, I charge £5.00 per day late payment, could you do something like that? Is it allowed for a nanny to do that?

(by the way my bank has a night safe so I can just stick cheques and paying in slips in there, but actually one of my Mums works next door to my bank so takes them all in for me on 1st)

28th was Friday - I think that you need to spell it out to them that unless you are both with the same bank money leaving their account on the 28th wasn't going to be in your account by today. Thursday is more likely.

I would talk to your bank, and explain the situation and ask your bank as to how the SO should be set up ino order to get to you by the last working day of the month. Once you have the appropriate description then pass this on to your employers.

You are being treat diabolically in this respect. They wouldn't settle for it form an employer, so I don't see why they expect you to.

i have no idea if its 'allowed' to have a late charge...

but given that its not in their interest at all i can hardly see them thinking its a good idea to add it into my contract either

If i charged £5 i day the total extra they would ahve paid me would be £750 and counting...

We are also not with the same bank and I have had soo many problems with other banks before(and none at all with my current bank who have actually been postively helpful ) i dont intend to change banks either!

If i ever get round to visiting the bank I will ask, but i wont be making a special journey to do it!

Very true... the NHS alwys pay them on time

It just makes me cross cause there is nothing i can actually do about it.

(wouldnt have minded the word "sorry" in the reply from my bosses either, but i didnt get it )

my work brain isn't in gear yet, but I think its illegal for them to pay you late full stop. I'm sure a contract of employment must specify when you get paid (even if you dont have a written contract if you have agreed it verbally it would form part of your 'contract'). I'm also pretty sure that they have to pay employers national insurance contributions on time (but not sure how long they have for this).

Like others have said - deliberately incurring bank charges is likely to cause you more harm than them (it can affect things like your credit rating for starters) but you should claim any legitimate charges back from them.

If it didn't go out until Friday then you're unlikely to get it before tomorrow, possibly not until Friday .

sory - missed reading the last page before my post! The problem with standing orders is that they take 3 working days and there has been a shortage of working days since the 28th. Still no excuse for not making sure you get paid on time though.

A standing order on 28th to reach your a/c by the end of the month is not early enough. 28th was Friday so, of course, it has not got to you by Monday and I am not surprised that it is not there today. It should be 25th IMO (not that that would have made a great deal of difference this month.

gr1973.... even though it probably IS illegal for them to pay me late there is excatly NOTHING I can do about it and no penalties for them either

I guess I could leave but that would be cutting off my nsoe despite my face and would be negative for both of us and probably worst for me!

especially as a couple of MY nanny friends are currently job hunting and would LOVE my job! and im sure my bosses would be happy to have them as the new nanny if i left, which i dont intend to!

When I had a nanny, the money sometimes took a few days to reach her bank account after leaving mine. I set the pay date to take account of transaction time but it still ended up being late once or twice due to weekends/bank hols. I think banks do very nicely out of holding onto their customers money. I shifted the pay date so it got to her even earlier.

Could you get them to pay you through a payroll service?

get your bank statements together and total up any charges or interest accrued as a result of late payments over the past year. And then give them an itemised bill.

Do not leave their house tonight until they have transferred your wages into your account. Then get them to write 11 cheques for your wages which you will keep and bank so that your wages are in your account that they are due.

If they are just doing a money transfer it can still take 5 - 7 working days so if they did it on the 28th in may not be in your account untill friday 5th or monday the 7th Jan.

thankk all

have not actually ahd any bank charges (actualy think there was 64p about a year ago but thats it) but that is cause i jiggle my money aroudn into my current to pay my mortgage etc when they pay me late.

which in principle i refuse to do anymore.

(i also have a huge authorised overdraft and a significnat intrest free overdraft as well to buffer any fees)

Have also decided that on principle i REFUSE to GO to the bank and pay in cheques EVER
(cheques also take ages to clear, about as long as doing it online anyway)

  1. im work with the children all the hours the bank is open... doing my 11 hour day, no lunch break etc being a nanny!
  2. its 2008, we both have internet banking AND broadband so i dont see why either of us need to go to bank. I do everything possible online anyway, as do my bosses!
  3. i work long enough hours as it is and i REFUSE to spenf MY time going to the bank (and then paying £1 to park just to go bank)

You shouldn't have to go to the bank! Who pays their employees by cheque these days? The buggers should just set up a standing order. But then you know this.

I suggested that NannyL had post dated cheques so she could put into the bank so that they are cleared funds in her account on her payday.

But I can understand why you wouldn't want to go to the bank.

Hi nannyL,

You said that you had a big serious chat with them just recently about your pay - I think December was the first month that you were due to be paid since then? If you take them at their word and they did set up a standing order on 28th it may be that it didn't occur to them that it would take so long. December is an ufortunate month for them to have set up a standing order near the end of the month with all the bank hols!

It takes 3 working days so I would ask them to bring the standing order date forward to around the 24th of each month to make sure it got to your account on time. Good luck next month!

gr1973... the 1st month after our big chat was November... and for the 1st time ever i WAS paid on the rigth day

Yes December is an unfortuante month but its hardly MY problem.... everyone of us has an almost infinite amount of notice about the days the dates are, and bankholidays etc!

indeed its not your problem, that's why if it was me I'd ask them to bring forward the standing order date. Any month where the 28th falls on the Friday will result in a late payment for you.

i WILL be asking them to move it forward.... looked through the calender and paying me on 28th will not 'work' for most months this year actually

(I WAS paid today btw... at last, thnakfully before ALL my direct debits, mortagage etc leave account tomorrow_
