Just that really. How can she contest the verdict? The evidence is pretty damning. I wonder if there is new evidence we haven't heard?

Smith isn't appealing the sentence. It's been referred for review (of the length) because it's been viewed as unduly lenient by the Attorney General.

Are you seriously questioning why she should have a longer sentence? She was an accessory to murder fgs, they should throw away the key. For both of them.

No, not questioning them increasing it. Just wondering on what basis, would they have new evidence? I personally don't think she was involved in the actual murder and was young and seemed very influenced by S but certainly allowed it to happen.

What sentence could she get?

I think it's because it's viewed as an unduly lenient sentence. 8 years, I believe. For allowing her lover to kick that beautiful baby to death. No sentence is long enough for that, I'm afraid 😡

No new evidence but 'they' have 28 days from original sentencing to change it.

The judge probably looked at her and thought she’s a young woman who made a mistake. 8 years is a joke. Certain people get much more for far, far less. Ridiculous. I’m glad it’s referred for review.

No it's not about new evidence, it's purely about whether the guidelines on the length of sentence have been applied properly by the original judge. Deciding on a sentence has a set of specific guidelines which judges use to come to a decision about sentence type and length.

She isn't appealling and she isn't contesting the verdict. It's been referred to the Court of Appeal by the Attorney General to see if the sentence is too lenient.

Because on the sentence she has now, she will be up for release in about 4 years time due to time spent on remand. Even her daughter didn't get 4 years of life 😔

When you put it like that it seems way too soft.

It's a tricky one. I wonder how much she was manipulated by Brockworth. She seemed to try and break up with her repeatedly but then hours of phone calls later she was back together with her. I just wonder if she was sound of mind given her IQ. But she must have known where those bruises came from. How shouldn't she? I don't buy the she's scum line though.

If she didn't commit manslaughter how much longer can she get?

It wasn't enough and it should have been harsher first time around. Shouldn't have to go to appeal etc.

The sentence is being reviewed to decide if the judge applied the guidelines correctly or whether a longer sentence should be imposed.

Starting point for the judge based on harm and culpability was 9 years, reduced by 1 year by judge due to mitigating factors of domestic violence and no previous convictions. Will be interesting to see the outcome of the review.
