Renting no deposit

Hello

I have to leave by 1st feb. My land lord came out said house wasn't perfect before we moved in so she's happy for no charges

Now she is saying if it is left on good condition she won't add on charges.

Rent Is £450 per month. How much can she charge me and what for?

She said this in person so I can't prove she said no charges. She's also going back on her word a lot.

Should I just ask her? She's not the nicest and plays games. She looked about the house and said no charges. But then she didn't look at every tiny thing like a bit of the oven has came lose like the bit around the door. And there's wear and tear in the painted doors in the kitchen, there's wear and tear on the carpets and bathroom floor but she seen all of this when she came out.

Your deposit should be protected in a scheme. If there are disputes around withholding they should be raised through the scheme.
This is the case in Northern Ireland anyway..

Check if the tenancy deposit protection rules are the same where you are located.

Ask her for the details of the scheme under which she has protected your deposit so you can raise it with them. If she hasn’t Protected your deposit but she should have, she is in breach of tenancy laws and can be reported.

Do you have a tenancy agreement? That should define what wear and tear is and that your are not responsible for it. How long have you been living there?

It's hard for them to prove that something is pr isn't wear and tear, TDS tends to be on the tenants side anyway.
Even if the landlord could prove that something has been damaged/vandalised their recourse is limited to a % of the cost of replacement. For example, if the carpet costs £1000 and its expected to last 10 years, you're moving out on the 8th year, but you've got gloss all over it, the landlord would be entitled to claim back 2/10 -£200 off you.

What's on the inventory? The inventory is where most of the landlords case for recourse from you would be made.

My landlord sent me photos as I moved in to show me how the house looked.

The carpets already had wear and tear etc.

Is there a cap on how much she can charge? Or can it be £1000s?

Nothing is really damaged beyond repair would that mean she could charge a small amount?

It’s really common sense what is wear and tear. If she does take things you don’t think she should then you can take to the dispute resolution scheme. When you first mo Ed there there should have been an inventory. So have a look at that. Important to leave it clean.

She can’t charge you. She can only not return your deposit

(Well I suppose theoretically she could take you to court for damages if you really destroyed the place - not sure - but that’s really not going to happen here)

Why was deposit returned? Wear and tear is not chargeable, carpets etc have a lifespan. She said she will not charge you so why are you worried?

She can’t “charge” you anything, she can only with hold the deposit and even that is not allowed for fair wear and tear

Can you clarify where your deposit is ? If she did not protect it in a govt scheme she is in big trouble and could be liable to pay you 3 x it’s value

She can’t make you hand over any money.
Speak to Shelter, but basically - keep your tenancy agreement when you move out, and take close up and more general photos of EVERYTHING. Then you have evidence that it was all in fair “worn” condition. She’ll get nowhere if she tries small claims court - this is what a deposit is for, and the rules around them are strict.

If she’s already returned your deposit she can’t really charge you for anything. She can try but she’d be unlikely to get anything

If you've already got your deposit back then the only ways she can get any money back are:

  • if you agree and give it to her (dont do this for anything that is "wear and tear")
  • if she takes you to court and wins

Whatever she would charge you would come out of your deposit, which you say you already have.
