Hi, asking for advice…

Is it possible to work in a school/ hospital setting as a contractor with a spent conviction for assault?

It will come up on a DBS check so it will needed to be declared and it’s up to the employer to decide if it’s appropriate for them to work there.

It’s up to the employer. They’ll take the circumstances into account and how long ago it was. But, yes, perfectly possible.

You often get a prohibition order for assault.

If it was more than 11 years ago then it's highly likely that his employer won't even be aware of it. Convictions for assault can actually be quite minor, but something like AOABH, GBH, Assault on a female or boy under 14 will always be disclosed to a potential employer

I got a conditional discharge years ago and I've always wondered if it shows up aswell. Interesting that it probably would, even after over a decade.

If the role requires an enhanced DBS it will show even if spent, best to declare it, especially if it was a long time ago and a relatively low level assault, it won't stop you working in that environment. GBH or a physical assault of a child more likely to be an issue.

@HolidayTime2021 where do you live? What do you mean by prohibition order? I work in the criminal justice system and this doesn't tally with my knowledge/training.

It’s never spent for a job in schools. It depends on other factors whether you’d be employed but it would always come up in interviews, if you got that far.

I think that the term “spent” conviction is a bit of a misnomer. If you’re going to be working in a school or hospital where you need a DBS then they can still see all of your “relevant” convictions so it’s better to declare them.

Some of the advice on here is wrong and it's important people don't give up information about themselves regarding previous convictions if the employer isn't legally entitled to know about them.

A lot of offences are eligible for filtering which means they don't appear on a standard or enhanced dbs check, providing a certain amount of time has passed and you weren't given a custodial sentence.. 11 years if over 18 at the time of the conviction.
Assault is a charge that is eligible for filtering.

There is a list of specified offences on the gov website that will always be disclosed on a dbs but any other offence not on that list won't be disclosed if enough time has passed and you weren't given a custodial sentence (suspended or actual jail time.)

There's a website called unlock which has some fantastic information regarding this and also has flow charts etc for you to work out whether or not you have to disclose certain information about your criminal record.

I also got a conditional discharge, it was 13 years ago. So long as it wasn't for a specified offence (mainly violent, sexual and safeguarding offences but there's a list on gov website where you can check) then it won't show up now, even on an enhanced dbs check. People are spouting false information on here which is worrying.
