To postpone divorce petition due to exh losing his job .

My husband from whom I am separated for over two years has lost his job.He will be given redundancy payment. He also does nixers for cash in his spare time. He doesn't seem too bothered but I am
Worried as he does not pay what we agreed as it is.
I literally have the papers ready to be served to divorce him. I have more assets, possibly worth £80k inclusive of pension that he would be entitled to some.
We co own our property and he pays my share of the mortgage in lieu of maintenance.
He has no savings or pension in his name. I suspect he is squirrelling away cash as savings.
His intention is to do nixers when he finishes his contract and then find a job.
So on paper, he will not be earning .
Would I be nuts to petition for
Divorce now ?

Wtf is a nixer

Elbie79 · 31/10/2021 20:40

How long have you been married?
Do you have DC?
What are nixers?

winterspices · 31/10/2021 20:42

A nixer is a job, often DIY/ building/ plumbing/ that a person does for
Cash and doesn't declare for
Tax reasons.
Three kids

Nixers are cash in hand jobs, right?

winterspices · 31/10/2021 20:44

Yes sorry

You need to talk to your solicitor before issuing anything, a change in circumstances (plus tax avoidance?) would alter the petition?

winterspices · 31/10/2021 22:24

Thanks! Any other thoughts on this please ?

He should be paying cms as well as half the mortgage.
If you have to sell he will end up with half the equity so effectively he'll get some back.

Hankunamatata · 05/11/2021 19:26

You need to go to go back to your solicitor and get proper legal advice. I

EmmaGrundyForPM · 05/11/2021 19:29

Presumably you were happy with him doing cash in hand jobs before you separated? This is the consequence.

I have a friend in a similar position. Ex has a high income but on paper earns very little as he doesn't declare most of it. When they split up, she got very little child support for their 2 kids. Yes it's shit and very unfair on the children but not surprising

MrsKeats · 05/11/2021 20:50

But you can't do cash in hand jobs without declaring it though.

Plenty of people do this, the guy who did our roof on previous property was cash in hand.
MrsKeats · 05/11/2021 22:39

That's illegal though!
All income has to be declared to HMRC.
Dear me.

Of course you can. Illegal but people do it all the time.
JSL52 · 06/11/2021 07:49

Illegal not to declare it I meant.

GoodnightGrandma · 06/11/2021 07:50

My window cleaner is cash in hand.
Both local barbers are cash only.
It’s not unusual.

What are you chatting about? Everyone knows it’s illegal. But it’s also rife.

Tell that to Boris, Bezos, Musk and just about every other politician or billionaire business man.

Well, you can. Should you? No.

Tax works in this country by Self Assessment, i.e. people report on an honesty basis.

Not all people are honest.

EmmaGrundyForPM · 06/11/2021 10:24

I refuse to use firms or workers who are cash in hand. Even though they are cheaper. Our window cleaner offers bank transfer. Just because big corporations and rich people are getting away with tax evasion doesn't mean we all should be.

OP if you were happy with the arrangements previously, you need to suck it up now.
