AIBU to expect some sort of compensation?

5 weeks ago I bought a used car, it broke down last week and needs £3000 of repairs. The person who sold it is a family friend and his business is a Ltd company. AIBU to expect him to help with the cost of repairs?

@RubyKitty

If he’s a trader then by law I believe you get a minimum of 3 months warranty so go back to him under warranty. He should have a policy that covers this
Lots of misinfo on this thread, this no requirement to give any warranty at al

www.lawgistics.co.uk/blog/articles/warranties-the-legal-requirements-when-selling-second-hand-cars/

No point in going back about that unless he did give one

SirensofTitan · 28/10/2021 17:30

@WickedWitchOfTheTrent

Did you try to take it back to him and ask him to fix it?

If you bought it through the company then by law he has to offer a warranty of some sort.

No, they don't, where are posters getting this from?

No requirement for an additional warranty. All cars bought from a dealer are covered for six months.

Platax · 28/10/2021 17:36

What checks did you do before buying the car?

SilveredPinkPetal · 28/10/2021 17:52

I think a lot of used cars are sold with a 3 month underwritten warranty, check his website.
We were once told this on a car purchase

Clown1 · 28/10/2021 21:31

I'll try to give you all the info now.

He sourced the car for us and we have a receipt with his company name on ** Autos Ltd.

It's an Automatic 7 seater. Within 2 weeks a warning light flashed up to do with the emissions. Cost 500 to repair. Not a big deal so we just had it repaired.

2 weeks later it wouldn't go into gear and AA recovered the car. Its with the garage now and they've quoted 2500 to strip the gearbox.

I spoke to the seller and he told us we'd be better off scrapping it.

We've just relocated from one end of the country to another and desperately need to be mobile for out house move next week and don't have the money to buy another car and a 7 seater rental car is not an option at 200 a day.

Ignore posts above. If you have a receipt from a garage, friend or otherwise you have rights. He has the right to take the vehicle back and repair it, but if not repaired you have the right to be refunded.

Werehamster · 29/10/2021 01:22

Thank you for explaining. I think you need to stand up for yourselves and put in a complaint to this guy. If the receipt has his company's name on it, then he has a responsibility to you. I know it's awkward, but you have no other option but to pursue this. This is business. He knows what he is doing is wrong.

Ok do this makes it clear

Consumer rights act is applicable here. He legally has to repair within the first 6 months, unless HE can prove the issue wasn’t there at the time of sale. The burden of proof is on him, legally it’s deemed to have been there.

You can go back to him with this, let him argue if he likes but if he won’t fix, you’re entitled to it so it’s small claims (gov money claim)

The law is absolutely clear here, your only challenge may be getting him to comply

Spot on, sorry this is also true.
BillMasen · 29/10/2021 12:22

Also, unfortunately you may be without the car for a while. He doesn’t have to provide a loan car, and if he argues it might take months.

We had this. Bought car in June, issue after a week. Finally mended in sept

HPmagic · 29/10/2021 12:28

It does not cost £2500 for a new gearbox to be installed. Ring around local garages for a quote

You can not make this statement. Op has said its a 7 seater auto, this is not going to be cheap. However op shouldn't be paying (or have paid) for any of it.
