Not my fault

Name changed as this may out my previous posts.

Had a car crash 4 weeks ago. Their fault - my cars been fixed by the insurance- anyway, the crash has done a lot of damage to my back and neck. I have soft tissue damage and I can't remember the name but somethings happen to my neck that's not going to fix itself - ever.
I was signed off for 3 weeks but the physio has asked the doctor for another 6 weeks.

My job is very hands on and my back needs to be good before I go back.

The thing is I can't get my wages paid (care sector - get paid for what you work)
The solicitor said they can't get anything until it's all over.

I can't pay my bills - what do I do?

Aibu to think this isn't my fault and it may get me into debt and or a bad credit score!

Contact DWP today. If you pay NI they can pay SSP.

Ask your solicitor to ask for an interim payment. Seems like liability is not disputed and whilst they won't want to settle a final payment until they know the extent of any permanent injury, an interim payment for loss of wages should be straightforward

I thought SSP was paid by the DWP so you are surely entitled to that. Definitely contact the DWP.

I think you might qualify for disability and/or statutory sick pay from the DSS?

So need to tell your solicitor to ask for a without prejudice payment for loss of earnings from the third party insurance company.

Provide documentation to show loss of earnings - the rota for that week.

It might not be quick though to claim it, could take a few weeks.

If you are formally signed off your company is legally obliged to pay ssp and claim back from the government. If they won't (find a new company) you can make a claim directly to the DWP. The info is normally on the sick note.

You may be eligible for UC but for a temporary disability you won't qualify for PIP or DLA. I have a long term disability but because an operation will cure it I am not eligible. The fact the hospital refuse refuse to operate and have done for 10 years because I am too young (over 40) has been deemed irrelevant. So something lasting 6 weeks is unlikely to be awarded.

Your solicitor could request an interim settlement or you cam speak to CAB for assistance, you may qualify for ESA

You'll get SSP as long as you work enough hours.

The only sick pay I get is £80 a week approx

My council tax alone is £240! I do have a dh and he is paying as much as we can afford that we have money spare for food and fuel.

Thank you all for the answers. Il phone them Monday and ask for what you have said as I did ask before and they said no. I mean they are taking 25% of my money - I don't care about comp money or anything. It was just an accident. I'm just worried about my wages and bills.

Companies can't claim ssp back anymore. Haven't been able to for a good few years now.
