WIBU to ask landlady for partial refund?

I've recently bought a property of my own and got the keys on the 27th July. I notified my landlady on the 30th and gave her a months notice as per the contract. Rent goes out on the 1st of every month. I have up until the end of the month to leave. I thought it would give me plenty of time to pack all my furniture/belongings up, sell anything that I no longer want, clean the old house etc. I also work from home and don't have WiFi set up in the new place yet, although I could work from my parents home if I wanted to.

Landlady showed someone round last Friday. She's phoned me today to say they want it but have asked if they can move in on the 20th (something to do with their current rental). Nothing was mentioned about a partial refund though so I'm not sure if she expects me to move out earlier, but for free. WIBU to tell her I can be out by the 20th (I can spend this weekend finishing everything off) but since I'd be moving out 11 days earlier than planned, I expect a partial refund?

Not unreasonable at all, If you're paying for the whole month then I would expect to be able to use what I'm paying for. I would just ask her to let you know what the adjusted final rent will be.

Definitely. If you asked to stay on for an extra week after the end if the month she would expect to be paid. In fact I would agree to move out as long as rent refund and all deposits are paid by the day you move out. You are doing her/ new tenant a favour so the ball is in your court.

Yes you have paid for the right to occupy the property for the whole rental period. It is irrelevant if you are actually living/ sleeping there. It is like when you go on holiday you are still "in occupation".

You can say you are happy to negotiate leaving up to x days early in exchange for a pro rata refund of rent.

Perfect, thank you all Smile I don't think I'm being unreasonable, but just wanted to check. I'm normally a live and let live type of person and if it was a couple of days earlier then I wouldn't bother asking, but 11 days is a big difference imo. I'll speak to her tomorrow and see what she comes back with Smile

You absolutely should get a partial refund, I wouldn’t agree to move out earlier unless they confirmed I’d get my money back for the days I wasn’t there. If you were moving out early for your convenience then no you probably wouldn’t get a refund but if you’re doing it for their convenience you absolutely should! Otherwise they’re getting double rent for that period

In those circumstances I would have mentioned it myself if I were asking someone to move out early.

You absolutely must ask for this refund. Please don't be shy about it it's almost another 2 weeks rent that you'd be paying otherwise.

Landlady here. I would refund in this scenario.

Can I ask people’s thoughts (since I have you here) on the opposite situation. A tenant has moved out a few days early of her own accord. We made it clear she could stay right up to the end and would not be marketing the property before she left. She has gone early because she is on holiday this week. I am not refunding anything. Is that tight ?

Absolutely ask for a refund, she'll no doubt be charging the new tenant for those additional 11 days so effectively getting double rent.

@AnyFucker - in your case I wouldn't. She's chosen to move out early of her accord, the property is available to the tenant until the end of the month and you don't have someone moving in early to cover that rent.

Yes. I have done that in the past. Divide month rent by 30 xby 11, and I would refund that amount, as can't rent to 2 people at once.

I'm sure she's expecting to adjust the rent paid. Don't hesitate to mention it.
