To think my boss should have given me holiday?

I work 2 days a week. Two weeks back at 8pm the night before I was due in at 9am I text my boss as I had a family emergency and my boss let me have the day off and as holiday. The following day I injured myself and I haven't been able to work the 3 shifts since. I asked my boss if I can have them as holiday and they said no. Are they being unreasonable to refuse?

No, it's sickness absence.

Potatoy · 08/08/2021 18:50

Seems fair enough. It's not really a holiday.

MaMelon · 08/08/2021 18:52

No, it’s not annual leave - you’re not fit to work so it’s sick leave. The fact that he allowed you to use annual leave to cover a family emergency previously is a completely different situation.

Darbs76 · 08/08/2021 18:54

Technically he’s correct, I’m usually flexible with this

AlexaShutUp · 08/08/2021 18:54

You're unable to work because you're injured, so it's sickness absence not holiday.

pinkmoon18 · 08/08/2021 18:56

Your boss is correct

dementedpixie · 08/08/2021 18:56

.gov website says you can ask to takenit as annual leave especially if you don't get sick pay

An employee can ask to take their paid holiday for the time they’re off work sick. They might do this if they do not qualify for sick pay, for example. Any rules relating to sick leave will still apply

dementedpixie · 08/08/2021 18:57

www.gov.uk/taking-sick-leave from here

BritWifeInUSA · 08/08/2021 19:01

No harm in asking but your employer doesn’t have to let you use your annual leave for sickness. Some do. Some don’t.

icedcoffees · 08/08/2021 19:08

You're allowed to ask but he's allowed to say no.

If you're sick, you're sick.

Planty13 · 08/08/2021 19:17

It’s exactly the way my work operates and it seems entirely reasonable to me. We are not allowed to use holidays when sick.

Bingbong2021 · 08/08/2021 19:28

But they don't have anything to gain from saying no?

OP posts:
Mamamamasaurus · 08/08/2021 19:32

Doesn't matter - you're unfit to work. Therefore sick time is taken for this.

MaMelon · 08/08/2021 19:52

It all depends on their HR policy on absence. Why do you think they should allow someone who’s not fit to work to take annual leave?
Hankunamatata · 08/08/2021 19:55

If you reported yourself as injuries then I'm pretty sure legally they have to put it as sick

icedcoffees · 08/08/2021 19:56

@Bingbong2021

They do.

They need to manage sick leave - if someone goes "on holiday" whenever they're sick, they can't monitor absence properly.

It also means you're actually using your annual leave for genuine time off, not to cover sickness.

It's the same as if you're sick while on annual leave - you can get your annual leave cancelled to use when you're well.

BrieAndChilli · 08/08/2021 19:58

It’s because you are legally supposed to have a certain amount of time off for a break and being ill/sick means you aren’t having a proper break. It’s like when you are very poorly/injured while on annual leave, they are supposed to give your holiday back to you.
DH ended up in hospital at the start of a week off work and so they gave him back his holiday as bad to count is as sickness absence
