AIBU to park my car here?

We moved into our current house a couple of years ago.

The set up is quite strange in that for some houses our drives are "split", with the public footpath in between.

This is not the case for houses that front straight onto the road, but only for those of us with landscaping areas between the house and the road.

We have a main drive, then the public footpath, then a bit that runs through the bushes to allow vehicular access to the road.

In all cases these extra sections are on the deeds as owned, rather than a ROW and some people pave them to match the rest of their drive.
Ours is not paved (just the original tarmac with edging blocks) and is wide enough to easily fit a car, though we don't usually park there.

We live on a corner so cars cannot be parked on the road outside without it being dangerous.

It quickly became apparent after we moved in that our lower drive is used as a shortcut by pedestrians coming from a footpath opposite. We have no problem with this.

They cross the road at a diagonal and cross the drive to the footpath as it's a shorter route and wider pavement than the other side.

This is all for background. But my AIBU is this.

We have had a major leak in the bathroom. The entire thing has to be ripped out, dried and redone.

The insurance company has provided a massive mobile bathroom for us.

But it's on the main drive and I cannot fit my car on there too.
So for the past couple of weeks (and for the foreseeable future) I have been parking on the lower drive. The car fits entirely on our owned section between the bushes and is not impeding the public footpath between the two sections.

This means pedestrians cannot currently use it as a shortcut and I've had a fair few people make nasty comments and complaints about how I shouldn't block the "path" - essentially they've come to think of that section as a public path.

So am I being the unreasonable one here?

Diagram included as it's parking thread law.

@TooBored1

I'd be tempted to put notes on my car stating that it's parked on private land, not a path.

Please note, my car is parked on my private land. Just as with other neighbouring houses, this land forms part of my garden and is NOT part of the footpath.

This sounds good

@NotYourCupOfTea

Where is the correct access to the footpath? Might be worth a sign to point people in the right direction But absolutely park there
Another good idea

I think you should put a note on your dash board that can be seen from windscreen

My car is parked on my private drive. As the rest of my drive is full right now
GET OFF MY LAND!!
Use the public pathway access 12m that way 👉🏻

I’d section it off with a fence behind to make it clear it’s your driveway or have a “private driveway” sign made up. It’s ridiculous that people assume it’s a public right of way.

I have t read the whole thread, but having got as far as the second diagram have to award a gold star for excellence. The clarity- top notch. Bravo!!

Are you allowed to block off the other end with a hedge or a row of pots as that will make it a clear demarcation for the future whether you are parked there or not .

I wouldn't be able to access the main drive in future if I did that. I normally park at the side of the house

Might tt help to put up some sort of border at the sides so that your access isn't impeded but it shows the land is owned, IYSWIM?

MaggieFS · 09/08/2021 08:56

Why not go the whole hog and get automatic gates installed across the very bottom of your drive. It would only take one pair at the bottom to block the through route Grin

(Although obvs penguin bollards would be better, sadly less effective against wayward pedestrians, unless you install an entire colony of penguin bollards!)

You need to do this. Or people will continue to be mistaken. It's certainly a strange set up and I can see why they may be confused.
NinaBallerinaShoes · 09/08/2021 10:15

You have my sympathy. I have a similar set up - a public footpath crosses my drive. I also have a front garden that is parallel to the drive. I have two signs up stating that it’s a private driveway and garden but people still use the garden as a dogs toilet and the drive as a public footpath. I hope to resolve the issue with block paving, gates and higher fences when funds are available.

In fairness though, I think I would assume as a pedestrian I had right of way up your drive (the bit by the road, not up to your bathroom caravanny thing).

Doesn’t make the notes right, but I can understand why someone would be frustrated if they’ve walked there for years. I’d suggest a sign/your own note on your car clarifying the situation. If they moan to the council, you’ve got your deeds as proof Smile

@maddening

Who owns the bushes?
Everyone on the estate. We all pay a factoring company to maintain.

No room really. It's literally just wider than the car. It's a job to get out without getting scratched by berberis.
