How much notice period?

I’ve been in a job for around 7 weeks. No contract and still in probationary period. It isn’t for me sadly, it’s night shifts but I’m struggling with them, and they’re impacting my skin and my digestive system.
I’ve been offered a new job but not sure how much notice to give.
Am I right to think a week is the legal requirement at this point? Probation ends after 12 week’s apparently but I’ve only done 7.
Not going to just walk out obviously but I want to leave as soon as I am able to. Thanks

Depends what the probation agreement says, a week would be generous on your part.

LawnFever · 08/07/2021 08:39

Depends on your contract, can’t you check what it says?

DH just did similar and left for a new job while in his probation period because it just wasn’t for him, he gave them a week notice.

I’ve never received any document of any sort to confirm I’m employed there, the manager didn’t tell me I was in probation, I just asked other staff who said there’s a 12-week probation first.

I don’t have a contract or anything sadly, apparently staff don’t get a contract until they’ve been there for 12 weeks.

A week is fairly standard.

Employers have a legal obligation to provide a contract no later than first day of employment but in the absence of that you're right that statutory notice is one week in the circumstances.

Thanks everyone, I’ll give a week.

This is one of those that's almost certainly on a case by case basis, up to you and your employer to agree.

If you have any accrued holiday, you might be able to use that to shorten your notice period, eg they ask for two weeks but you only work until the end of next week and cover the rest with holiday.

Or they might be happy for you to leave in a couple of days, as they might not want you working or see any point providing any more training if they know you are leaving. Or it could be that they need you to work as long as possible while they arrange cover/start to find a replacement.

Talk to them about it and see what they say.

A week is correct. If your contract is silent on this (which I have to say is unusual in the extreme), then statutory notice after your length of service is a week.

In your position I said that I only needed to give a week but if they needed more I would do it. We settled on two weeks
