Suing the hospital for telling me I had cancer?

Can I? Should I? Family and friends are telling me to. I was diagnosed 2 months ago at a private hospital after MRI & biopsy. 3 surgeries later and now last week I've been told it isn't cancer at all. They had it looked at 3 times to decide it wasn't cancer so it doesn't seem to be a straight forward decision. I'm not sure it's the right thing to do anyway. I just feel how I did when I was diagnosed - like my life has been ripped apart again.

all roobicoobi@ no I am genuinely interested only I understand the basic but surely consent had to be given and a diagnosis of cancer would be dependent on certain factors one being a biopsy. I was just wondering if it was an assumption on behalf of the op rather than fact.

What you've been through is huge OP. All the surgeries and not to mention the mental trauma of living with cancer (despite there not being any).

And PP have suggested you should have more discussions initially. But I would be tempted to seek compensation at least to provide the necessary costs for breast implants and future maintenance as well as some private counselling.

I can't imagine where your mind must be. Don't rush back to work and normal life just because you don't have cancer, you're still recovering from surgery and trauma.

This is getting more bizarre the more I read a cone biopsy is done on the cervix following an abnormal smear.

I stand corrected but I still think there are a lot of questions that are not answered. For instance why go private when the nhs would see someone quickly in cases like this.

Why don’t you have an unnecessary mastectomy and lymph node op that leaves you unable to lift your arm above your head for the rest of your life, so that you can bask in the gratitude of not having cancer, either?

Maybe someone needs to reiterate for the people with poor reading comprehension.

The OP was misdiagnosed. She was told she had cancer and was informed she had to undergo surgery and treatment to save her life. They removed her breast and ALL of her lymph nodes from her arm pit, making it impossible raise her arm. She suffered and still suffers with great pain, disfigurement and anguish - as did her family.

She never had cancer but was treated aggressively for it. The OP needs answers and the people who mixed up the samples or read them wrong have to be held accountable so hopefully it doesn't happen to anyone else.

Well maybe next time the doctor wants to check your breathing he’ll cut you open and remove your lungs. You should be grateful.

I'm not so sure what you don't understand. All of the information is in my previous posts. I have Private Healthcare Insurance. Why would I not use it? Confused

You should complain, via PALS, NHS or private does not matter. That is step one. This is not a judgement. Your case went appallingly wrong and you are entitled to raise this with the hospital authorities and to get answers and appropriate redress including apologies and explanation.
THIS IS NOT A BAD THING THIS IS NORMAL. Never feel guilty about complaining.

Secondly, please see if you can access some advice on seeking damages for the harm you have suffered. There are a lot of ambulance chasing firms so take your time and do a little research before choosing a firm, or talk to a couple. You are so vulnerable so do not be pressured into anything.

It will the the medical lawyers job to look at the case and decide on the notes etc and expert advice on things like negligence but you are certainly someone who I think has been badly damaged and therefore should be entitled to receive a financial payout to reflect the lifelong pain and suffering physical and mental from what has been done to you.

Take the emotion of ‘I shouldn’t sue theNHS out of it’. You are entitled to seek redress for damages.

I am clearly a random on the internet but I do work in a senior position in the NHS so I’m not at all biased against it but this is not acceptable.

You think what about it is far fetched? I had a core (not cone) biopsy which was positive and then standard breast cancer surgeries. Or do you think hospitals never make mistakes or misdiagnose people? Wouldn't be a need for all the legal medical malpractice firms if it never happened would there?

I read the thread yesterday and have come back today and the OPs messages.

Honestly, I would be complaining and complaining until I got a response. Doctors are supposed to first “do no harm”. They failed at the first hurdle with you. You need answers as to how this happened.

And please ignore those who say you should be grateful you’ve had all this done for no reason rather than because you’ve got cancer.

I hope you get the answers/help you need
