Who would get this share of a house?

I’ve just asked this question on someone else’s thread but figured I’ll get more responses if I just created my own.

So my dad has remarried and he owns his house as tenants in common with his new wife (they owned said house before they married) and he has already told me in previous conversations that he hadn’t written a will yet. So hypothetically (awful thought) but if he was to die who would get his share of the house? The house is worth less than £100,000 if that’s helpful.

If there's no will it just follows the rules of intestacy. Depends on overall size of estate.

Sorry I’m not across the legality of it. Ask him what his intentions are. If he wants you to get his share then he needs to write a will.

If they are tenants in common even with no will its his wife to my knowledge.

@BlueSurfer there’s no other children involved except me and my brother and obviously we’re both adults.

And if he were to die first with no will, and then his wife was to die with no will it would all go to her next of kin, whoever that might be. If that's not what what he/they would want they need to be writing wills
