To refuse to pay to send these back?

I ordered some stuff for DD late last week.

It turned up yesterday morning. At 6pm I got an email apologising that my order was running late and they'd send it as soon as possible. I assumed this was a mistake.

This morning at 7am Hermes delivered another identical parcel and left it in the porch wihtout knociking. THEN 2 hours later I got a notification from Hermes saying they had a parcel which would be delivered this afternoon. I was out and got back a whilie ago to find a third identical parcel.

I've contacted the company who told me I need to parcel everything up, take to post office and return to them and no they don't pay return postage. They said I had only paid for one so needed to return the rest.

I've checked and thankfully they've only charged me once.

I've told them they need to arrange a courier to come and collect them as they're quite big parcels and no way am I paying return postage.

They refuse and say if I don't return them, they'll charge me for them.

Each parcel has about £90 worth of stuff in them so its a not insignificant sum.

Can anyone tell me what to do please?

They’ve sent you unsolicited items and they either arrange a courier or you will dispose of them in 14 days.

They are unsolicited goods - check out what to do on Citizens Advice website. Don't let them get away with it!! Good luck.

How did you pay? How many order confirmations did you receive? If you’ve definitely only ordered once, contact your bank and advise them you only authorised one payment and request they reject any duplicate payment requests.

Hahahaha absolutely not. It's their mistake so they need to pay to get the items. I agree with above, Twitter is usually good for stuff like this.

They are wrong. It's their error therefore they have to pay for them to be returned.

If they have your credit card number, block the card and get a new one... At least that will stop them charging you. And stick to your guns, they send someone out at a time convenient to you, to pick it up, or you dispose of them.

They can't make you pay for their mistake. Whoever you spoke to is woefully misinformed.

I definitely only ordered it once and only received on confirmation email. I have also logged into my account and the order is only showing once.

There are return papers but not prepaid Hmm

Thank you the link to Citizens Advice I will go and have a look at that and then decide what to do next. I don't mind making arrangements for them to come and pick it up but I do mind lugging them to the post office.

I hope they don't send any more, my hall way is starting to get a bit crowded Grin

Good point Scruffgrin will temporarily freeze my bank card until this is sorted (luckily got plenty of cash at the moment)

I'd be calling my credit card direct line and explaining the situation. If they decide to use your credit card against your wishes it's a very very serious offence. So much so their ability to accept credit card payments can be shut down resulting in huge delay to their business.

The VISA part on the bank card or credit card doesn't allow this type of unauthorised payment.

I had a vaguely similar issue a decade ago with duplicate crates of wine arriving and VISA stopped the unauthorised transaction sharply and returned the money.

They have supplied unsolicited goods, if they require them returned they must organise a courier to do door step collection.

I would go as far to email them and state that goods that were not requested have been delivered. You will keep them safe for collection until X date and after this you will dispose of them. I believe you have to offer the opportunity for them to be collected fairly.
I'd also be adding that you've contacted VISA about their threatened attempt at a fraudulent transaction.

Leave the ball firmly in their court.

You won't hear from them again. What you have is a frustrated employee who doesn't know the law but know they have messed up and doesn't want to be discovered.

Tempting to put them in the post with no postage then they'd have to pay to get them back. They sound ridiculous though - there must be someway they can arrange a prepaid label for you as it was their cock up in the first place. Get tweeting - I find a DM via twitter pretty effective for this kind of crap.

Their mistake, they pay to rectify it. Don’t back down over this, there’s no way you should fork out for return postage on a heavy parcel.

marchez is correct, they're not unsolicited goods in the legal sense. They've been sent in error. They do need to cover the cost of return.

Be careful sending them back without postage. I doubt any post office will accept them without postage being paid, and if they will, they won't give you a certificate of postage. As you've acknowledged that you have the goods, sending them back without any proof will leave you in a mess should the items go missing.

Push the retailer to pay for the return, or arrange a collection from Hermes if you're willing to wait in for them.

They aren't unsolicited goods (which you can keep) because it is a mistake (they have sent the same items repeatedly). They do have to pay for their return if they want them back.

You need to write to them and give them a 30 days to collect them at your convenience. If they insist that you have to pay for their return, you can report them to Trading Standards (you can do that via the Citizens Advice consumer phoneline).
