Fine for parking at Pure Gym

Son paid day membership. Parked for 1 hr 05 mins, thought he had 2 hours free parking with the day membership. Now has fine. Appealed with membership pin and has come back fine stands. They’ve not explained what he’s done wrong. Aibu to think they should spell out where he went wrong?

I've had one of these. I went to the manager of the gym and asked him if there was anything that could be done. The fine was taken away. I think it helped that I see the manager around the gym a fair bit.

I was always under the impression that if fines weren’t from a govt body then they aren’t enforceable? I’m in (NI) if that makes difference

Private parking companies are pieces of shit.

Tell your son to speak with someone senior at the gym, they'll be able to speak to parking company to get the ticket written off.

All the appeal stuff won't work and you'll ultimately have to fight it up to and possibly including court.

They are enforceable - despite many people still claiming that they are not

Any contract is legally enforceable if it is a legal contract. The owners / managers of a car park just need to put up appropriate signs about the terms of using the car park.

Or send proof you had right to park and to take to court if they won't cancel.

I once parked in a industrial estate which has 1hr parking on match days and 2 hours on non match days.

I was 1 hr 2 mins and returned to fine set after 61 minutes.

As did 12 more cars in the row.

The man said he couldn't reverse them after being written even though it was their mistake.

The company said the same and I must go through proper appeal channels to get the fine reversed.

Myself and 7 of the other cars all sent identical emails stating to take us to court if they wanted to enforce the fine.

8 years later and I've had no court date Wink

This may be slightly different if there were machines to type in reg but it still stands if you've purchased to park they have to prove by you not registering the car you've disadvantaged them financially in court to get payment enforced. This is because private parking is civil case not a legal case.

A few years ago we had a prom in local hotel and we had to drive through the car park.
Every parent got a fine and the hotel contacted the private company and got them all reversed as we didn't park.

It can be done. They don't need to enforce payment but some think if they are insistent you'll give up.

I had one company send letters about a parking fine. I ignored them. Nothing happened. Until they sold it on and I got sent a court date and had to go to mediation. I wouldn’t be so flippant as to ignore them now.

I joined a gym a couple of years ago where you had to enter your reg number on a screen but the reception staff strangely said nothing about it. They did however sort out the couple of parking fines I got before I realised, so that I didn’t have to pay.
