Driving accident

Probably a little outing but my DSis had an accident that wasn’t her fault. Car speeding and not paying attention went into the side of her at an island from the left. Car flipped a few times and she was very lucky to come out basically unharmed.

Police on scene breathalysed the other driver etc.

Will she get charged with anything? I’d like to think so. This was on a quiet street, literally outside a nursery.

Sounds scary. Glad she's OK. Your sister is effectively a victim of a crime, therfore I'd expect the police to share what has happened to the perpetrator. Its quite important to get over something psychologically that she knows what caused the crash and what has happened to the other driver. Make sure she empasises this when she deals with the police.

Whilst it was all undoubtedly terrifying .. the insurance companies and police will deal with it accordingly. The thing I would take away from it all, is that the other driver will most probably now drive very differently in future, will have had the wake up call she needed.

As others have said, it doesn’t necessarily take speed to flip a car, just the correct angles and impact points. The driver however, will no doubt be much more aware and vigilant in future.

I’m pleased your sister is okay, she’ll probably feel very rough over the next few days, and should get herself checked over, and continue to do so if she feels worse or doesn’t improve.

Unfortunately if there aren't any serious injuries or deaths then I doubt the police will investigate much. The at fault driver will be caught if they were unlicensed or uninsured, or if their own vehicle was obviously unroadworthy eg bald tyres, or if they were wanted for anything else. (Or if they had been drunk, but they weren't.) But otherwise I doubt there will be any charges. Yes a crime probably occurred but the chance of proving it is nearly zero.

Not necessarily sarsons ... they were entering a roundabout, so probably speeding up on entry ... you only need to hit a car at the ‘wrong’ angle, in the ‘wrong’ place ... depends also on makes, models, sizes of both cars.

Not necessarily - most people speed up on entry to a roundabout anyway, and like a PP said, it depends on the angle of both vehicles too.

You might speed up on entry to a roundabout but you should be slowing on the approach - the give way lines aren't painted there for fun

I was in a RTA (road traffic accident) nearly 5 years ago. Totally not my fault, I was driving along a long straight road at about 50mph. Other driver didn’t stop at a “Give Way” sign and came out of a side road, hit my car on the drivers side and I was shunted straight into a telegraph pole.

Other driver was completely unharmed, whereas I had several broken ribs, concussion and exacerbated an old spinal injury. I ended up unable to return to work and having to give up my job which I loved. 😥 I am now in constant pain (on Morphine), unable to walk more than about 20m with a stick, registered disabled and been unable to work at all since!

The police officer who attended the accident did put the case through to the Procurator Fiscal (Scotland), as he thought that I was very lucky to survive the accident. However, despite this being her 3rd RTA, they decided not to charge the other driver!

In effect my life has been pretty much destroyed (had to give up sporting hobbies as well as my job) and I need assistance with so many things and her life wasn’t really impacted! You may have gathered that I do feel quite bitter about things!

Oh, I know that.

But all it takes is for someone to be going at just the wrong speed at he wrong angle for a potentially minor crash to be 10x worse.

Any news on this op? I was makin my way across a yelloe box and speedinfmg driver went into me. He claims because i was in box as he hit me he, i was stationary in the box (wasn't at all) was driving through to a clear exit. Hes wrote my car off and his is fine. Insurance won't investigate speed so ill be going to a financial ombudsmen to fight it harder.
