Recruiter giving out my personal information

I was recently made redundant and I have started a job search. My former employer owes me money (unpaid wages £15k ) and it’s going through ET with a uk gov insolvency claim attached.

Former employer has contacted recruiter I am using to obtain information on my job search and reasons for me looking for new job. Recruiter has provided information 😡.

Whilst I have nothing to hide I am mad that recruiter is giving out my information in such a sloppy way. I’ve made a SAR a data breach complaint and I’ve told them to desist giving out my information to my former employer. AIBU here?

Former employer is trying not to pay unpaid wages. I presume they think if I get a new job they won’t have to pay! Sad

How did your former employer even know which recruitment firm you’re with? How bizarre!

Is a SAR the same as a GDPR beach? If not you can log that too

That's definitely a GDPR breach - either the agency reports itself or you should.

I do know that if you're going to tribunal the other side's legal team can produce pages of job ads that they feel you could have applied for. It's an attempt to minimise any payout by stating you made no effort to apply and mitigate your losses (of earnings). My knowledge isn't current though.

Yes they could provide job ads but I have applied for everything suitable at my level that’s available on the market. This company have only had 1 vacancy so I’ve used other agencies. I have letters of involvement from they key recruiters in my field

But you’ll have paperwork to prove you’ve been made redundant assuming it’s been done correctly so it’s documented, they can’t deny it no matter what

Is the £15k they owe you redundancy pay out or wages not paid?

You getting a new job and the money they owe you are completely unconnected, you could start a job the day you’re made redundant, it’s irrelevant to what you’re owed

Being made redundant doesn’t work like that though, you’re offered a settlement figure based on the years worked & your contract, other jobs available outside the business aren’t anything to do with what redundancy pay you get

No I don’t have an NDA - the money is unpaid wages .

I asked 3 recruiters about being called or emailed as the case maybe - 2 said they refuse to deal former employer. 1 said former employer had ripped them off 3 times and they won’t have anything to do with them at all. I then got told by a friend that when she was recruited by now former employer they refused to pay the recruiter. Recruiter who got ripped off and the other recruiter who helped me a lot have said they will write statements for me if required.

There is a serious one sided details missing here, 15K in missing wages is the big red flag before we even try to look at why recruitment agents are contacting your recent employer.

If this is genuine and you have proof, a simple twitter post to highlight this would gain more traction than posting on MN, but I feel it is a bit more nuanced than you will admit.

I don’t think it’s suitable to put a post on Twitter.
It at the ET - the only complexity is company is change in legal entity hence the insolvency claim attachment as original co is being shut down and new company starting. That’s it nothing more to throw in !

£15k is huge, it does sound like there’s more going on unless you’re a v high earner

YANBU - recruiter was completely out of line. There's one thing having loyalty to their "client" (your employer) but sharing any confidential information about you "their Candidate" is beyond unprofessional. Breach of confidentiality. You were right by filing a SAR. Are they a big or smaller organisation? Not that it excuses anything either way, i'm just thinking whether they have in house legal support or now sh**ting themselves as many small organisation struggled to implement GDPR to the letter...

My former boss is obsessed with money. He used to sit in the office and argue with staff about paying for a train ticket for hours on end even when the client was paying the bill. He is not very educated and he seems to think if I get a new job he doesn’t need to pay the money outstanding. He is just being stupid. Because I’m claiming through ET I can claim future losses and any future losses stop when I get a new job .

I would post negative reviews on all the recruiter’s online channels explaining that they breached your data like this. It’s so unprofessional and would put me off using them.

There is still some massive holes in this story, 15K doesn't get withhold on a whim, getting irarte of a recruitment agent sharing your email adress is ot even comparable.
