Posted here for traffic and NC.

After a turbulent, stressful and upsetting 4 months I finally got told the outcome of my Gross Misconduct investigation yesterday:

No further action/No case to answer.

I am fully aware of who reported the accusation(s) and believe that it constitutes Vexatious Harrasment.

My question is do I now go in with a counter claim citing harrasment? Or do I leave the dust to settle, act all smug for a couple of weeks/let her think there will be no repercussions for her behaviour/let karma do it's work?

Does she even find out about the decision thats been made?

I've spoken to friends and family and their thoughts tend to be go hammer and tongs but they are slightly biased in that they know what I've been going/put through over the last few months.

Thoughts??

There's no such thing as karma.

If you have a genuine grievance, then by all means take it through the proper process. If you don't, just leave well enough alone.

Nail her. My vile ex boss had a history of vexatious complaints. I took her to tribunal over it and won. (She had previously made 19 unfounded complaints against other people). People like this need someone to take a stand against them or else they just continue doing it.

Is it clear from the outcome of the Misconduct hearing that the complaint was vexatious? If so then yes, take it further. If you’re just going to heap more stress upon yourself then don’t.

Surely that the allegations constituted a possible charge of Gross Misconduct and that following investigation there is no case to answer is context enough??

That's great for you, well done!!! There have been a number of incidents in the past with various complaints against her conduct/how she speaks to people etc.... Everyone just gets told "that's just how she is, rise above it" and nothing ever gets down. 🙄

To add. It was discovered in the course of the investigation that she had lied in her initial reporting with regards to particular conversations.

Are you a member of a Union? And/ or can you talk to Acas for advice?
As pp have said it’s difficult to judge without knowing the circumstances or your industry also Mumsnet is completely line of duty obsessed so you might get some ahem, strange counsel

Well yes in a way, to know something bad and unfair has happened, but whether it would be best to let it be out pursue a complaint isn't necessarily just a matter of principle, all kinds of work politics could affect the wisdom of that choice. 🤷
