Holiday entitlement calculation

I leave job in a couple of weeks, not my choice but I've held head high and carried on working hard since I was told I'm going.

Jan/Feb were so hard, trying to help DC but also going in to work each day. I tried really hard to balance things but am ashamed work 'won'. I used up all my holiday so I could be home as much as possible but it wasn't enough and kids struggled massively.. My job was precarious and I didn't want employer to have reason to get rid of me but they did anyway.

My issue is that I realised my holiday has been calculated incorrectly. I work 5 days but less hours (6 vs 7.5). I believe I should have 23 days holiday as per contract but have only been given 18 days. My argument is that I'm 'paid' 6 hours when on holiday, not 7.5.

Aibu? Happy to be told I'm wrong but currently feeling so upset that I had another weeks holiday I could have used when I really needed it last month.

I’m not an HR person but it’s my understanding from being a manager that as you work less than FTE, your leave should be entitlement and taken should be expressed and calculated in hours, or it gets messy trying to define what constitutes a day’s leave.

Do you normally book your leave in days? That is likely to have lead to the discrepancy.

You should have the same as a full timer - so you are correct and you should get 23 days.

Could you speak to your manager/HR and explain you’re not sure it was calculated correctly as you got X figure versus their Y, and ask them to explain it/break it down? It’s a perfectly reasonable request.

So you work 5 days a week but the days are shorter? If so, you should get the same number of holidays as full time staff including the bank holidays they include for full time staff.

23/37.5x30 is 18

Your holiday is reduced because you work part time -

Is it 23 days plus 8 Bank holidays = 31days?
The minimum by law is 28 days so it couldn't be just 23 days you have as your entitlement

It's a full year. Bank hols on top. No HR 'dept', just the owner and his closely guarded holiday chart (hence only just realising the calculation error).

They are not correct OP works 5 days so gets full time entitlement. Her day off is just shorter than a full time worker

They shouldn't have reduced your holiday entitlement for part time hours. You work 5 days so you should get the same holiday entitlement as a full timer. Doesn't matter if you work 1 hour a day or 7 hours, it's still a 5 day week.

No you are incorrect. She gets the same number of days as a full time employee but her days are shorter. Your way gives her fewer days and shorter days.

@BluebellsGreenbells this is how they have worked it out, but when I take a days holiday, I'm not paid 7.5 hours, I'm paid 5.5.

If your working day is 6 hours your holiday day is 6 hours.

You don’t accrue then as a part timer and use them as a full timer.

Yep, this is where the hourly calculation would help - full time people get 23 x 7.5 hrs; OP would get 23 x 6 hrs. For OP to take a day off would require 6 of her allocated hours. A full timer would have to take 7.5 of them.

As OP works her shorter hours over 5 days, it’s tempting to do what her employer has done in working it out. Showing it in hours might help the OP get it sorted.

This is why leave needs to be calculated in hours, days doesn’t make it clear enough. Especially with part timers, compressed hours etc

No. She isn’t.

Part timers who work 5 days get 5he same number of days as full timers, but are paid for fewer hours per day. OP should get 23 6 hour days.

I'd say OP is entitled to the same number of days as the full time staff. Her days are shorter. She doesn't work fewer days.

You should get 23 days as a fulltimer, as your days holiday is paid at your part time hours. If you worked less than 5 days a week it would be different.

You should get the same number of days, but be paid your working day, not 7.5 hours.

How many hours per day were you paid for your holidays? Its possible they've calculated in hours so they've overpaid you there.

However, for a 5 day week, you can't legally have 18 plus 8, as the minimum entitlement is 5.6 x working week.

5.6 x 5 = 28 (inc bank hols)
