Collecting belongings

Have moved this from legal matters as had no response so hopefully someone here can help.

I've NC for this as it could be very outing.

Long backstory but basically my DF is elderly and has deteriorating health. DM has been manipulated by my DB (she doesn't have full mental capacity) and has chucked my DF out of their marital home. We have solicitors ect involved but at the moment we are trying to get access to the house to collect his belongings (clothes ect). They have not responded to our letter from the solicitor requesting this access so where would we go from there? Surely it's illegal to hold his belongings hostage?

Could you perhaps try the non emergency police? Ask to be escorted in to the house to collect things.

Is he on the mortgage/tenancy agreement? If so, he is entitled to break in to retrieve belongings or live back in the property. Your db sounds a delight!

Your dm needs to be told that she can’t just kick him out of his own home. He has a legal right to live there. She may find she has to sell the place to fund his care, depending on their circumstances.

We do this regularly for people - we call the police (non-emergency number) and they attend the property with us. Say you need an escort "to prevent a breach of the peace". They'll schedule a time for an officer to meet you - they'll only do it once and you can only take things you can prove are your fathers.
