Aibu - part time role

Posting this more for ideas than really aibu (as I think I am Being unreasonable but mot sure how to get around it.

I run a small service based business and now hiring an employee. The role is a flexible part time one, but in an industry where many people freelance.

Now to my issue. As the role is part time, unsurprisingly many applying seem to want to continue to freelance alongside the role. Completely understandable- but at the same time - it potentially puts my business at risk.

I’m considering adding a non compete clause but don’t want to put off a potentially good candidate and also am a bit concerned about what I’d put in it anyway.

Advertise on here, and make it part of the job they can't work elsewhere.
I think you'd get tons of applications. I don't think it's the advert but where your advertising it!
A WFH job around school hours (and pays better than a school job) would be snapped up. And you wouldn't have to compromise on quality as this site is littered with SAHMs who left great careers.

Unfortunately as far as I can tell advertising on here is geared to much larger businesses with several roles to fill. Which is a shame on both sides really.

The problem is it’s PT so having a non compete clause is going to be unreasonable for most people. You might find some, but the pool will be smaller.

That’s it isn’t it. I’d strangely have no issue with them doing a second job - but it’s the freelancing part I’m struggling with to be honest.

I do use freelancers and that’s all good I don’t care a jot what else they do but they don’t then have the same access to clients etc.

I think I’m going to have to just have a bit of faith in choosing the right person (if they are indeed a freelancer).

I do know I’m being unreasonable by the way! Am just trying to think of the best solutions.

This is a difficult space. There have been challenges to non-compete clauses on the basis that people are experienced and qualified to work with X type of corporates and hence not allowing them is preventing them working.
For instance, bankers often have non-compete clauses but they aren't generally enforced except if they've been granted stock and it's a condition.
So back to your example. If your client base is large or covers the major companies in town, then it could be difficult for a person to get work around it.

@NOTANUM it’s tricky as genuinely don’t want to hamper anyone and have a pretty light attitude to what they do when they leave.

It’s more I worry about what they do while they’re working for me. Itself! I think the fact that it’s remote is perhaps an additional factor. I really don’t expect someone to be say, answering a bundle of their own client emails etc.

I also worry a little that someone who also freelancers may be unclear around the difference (I think I’d struggle switching between the two “modes” myself).

But I will get some advice and see what happens. I’m really hoping to develop it into full time at some stage - but am trying to be a bit cautious.
