No repayments taken ... what would you do

Hi

Last year we applied for finance for our kitchen and it was approved. Kitchen installed and that side of things signed off.

However no payments have been taken from my DH bank account for the set repayments over 12 months which we signed up for ...

We contacted the finance company twice who can find no record at all of our application or account number . We have been told that by them a account would be created once the kitchen company put the request through for finance which they did and it was authorised .

It’s been quite a few months now and nothing. We can’t even get an account number for the finance account because according to them there isn’t one

What would you do now

I was going to ask if it was one of these things where you "pay nothing for the first 12 months", but that's out if they don't even have a record of you

Personally I'd put it in writing, send it recorded delivery and then simply leave it up to them. I'm not sure what else you can do, and at least that way you'd be covered if they ever come back to you

You should go back to the kitchen company and ask them to chase it up with the finance company. Presumably the kitchen company haven't been paid if the finance has not been created?

Write to them with the details, and also make sure you have saved/are saving the money elsewhere.

Therefore if/when they catch up with you, you won't suddenly have to find £Xk that you've spent elsewhere, but shouldn't have.

Have you checked to see if the kitchen company is actually still in business ? Maybe phone and speak with their accounts department who might be able to shed some light as to why the paperwork has not been filed with the finance company.

I'd put the money into a savings account as though you were paying, and then I'd pay immediately when asked.

I'd make sure you save the repayments just incase they do take them eventually. Have you asked the kitchen company?

In the meantime, direct debit the monthly repayments into a separate account so the funds are there when they come and ask

Like others have suggested I would put the repayments into a savings account and leave it there. Keep records of all your attempts to bring this to their attention and the repay when they eventually chase up the money. Which in all likelihood they will.

Have you checked there hasn't been a cockup between the application stage of the finance (which you say was approved) & the point at which the account needs to be set up / payments taken? A similar thing happened to us many years ago. We bought something on credit from X shop, since gone bust in the recession. Credit with a third party. Credit set up, I started making payments, but after a couple of months received a letter from X shop threatening repossession of the item unless we paid. I replied that we were paying, & sent a copy of the paperwork from the credit company... they'd lost their copy of the credit agreement & all paperwork, & couldn't prove to the credit company that they were entitled to take the money I was dutifully paying each month. They also couldn't prove they'd supplied the item either, so they'd have had no luck in repossessing it TBH.

Somewhat different scenario but my point is, sometimes shops & companies do make pretty big mistakes. Do you still have your copy of the paperwork?

Good point - if like so many they've gone bust, there may not be anyone for the finance company to pay the money to any more

You need it in writing that you've contacted them. Either email or post. So they cant charge you any interest on delayed payments when it's their fault. Then leave it up to them. Keep the money aside for a few years just in case

Set up a standing order for the fixed amount that you’d agreed every month. Get written confirmation that you have attempted to contact them etc and make notes of dates times and contact of any phone calls. as if this has been passed on to debt collection due to their errors you don’t want to be liable for the extra costs and you want to be able to prove you’ve been good to your word and kept the payments aside and made reasonable attempts to contact them.

I’m not sure how you stand legally if the company have gone into liquidation, there is no doubt you owe the money and there is still a possibility that your debt could be sold on and again, you don’t want to end up fighting the extra costs if this is the case. Having said that it is possible you could end up with a free kitchen.

Don't ignore it and assume you've got a free kitchen, that could backfire on you spectacularly. Someone will realise at some point and then interest may be due (at potentially very high rates) and, depending on the severity bailiffs could be involved.

Dig out your agreement. Check what happens if payments are missed; what are the charges and procedures to recover debts?

Contact the kitchen company and the finance company - in writing. Keep records of everything.

Be very clear when you contact them that you owe them money and you are trying to get it paid.

Is there a physical office which you could visit when covid restrictions allow?

1 - Make sure you have written proof of all your communication with various companies.
2 - Put the money aside each month just in case,

Save the money.
Write one more letter to all involved sent recorded delivery.
Do not communicate with them unless they contact you. After 6 years they can no longer claim the money back. If they come after you, you need to send them a recorded statue barred letter, but only after 6 years of no contact from either party.

Can you contact the bank and check that no attempts have been made to set up a repayment that has, for whatever reason, been blocked?

You've brought it to their attention, they are not interested in taking repayment.

In your shoes I would get a copy of my credit report to ensure there are no missed payments logged and if not send one final email to shoe you have attempted to make payment, if not already done so, and enjoy a potentially free kitchen
