Renters won't leave the house I'm buying, they 'can't find anywhere suitable'.

But thanks to covid, a section 21 means people have 6 months instead of 2 months to vacate and this means I get charged £4,250 extra in stamp duty, plus mortgage application fees and survey of £1k plus my life being on hold for 6 months.

They are fully aware of my position, they know I'm a single mother of 2 small children and they don't give two hoots that they're actions are costing me £5-6k and months of waiting.

God give me strength to get through these next few months without attacking them on a regular basis.

What would you do in my situation???

I would pull out or negotiate with the vendor to reduce the price by £5-£6k.
This. It is for your vendor to resolve or take the hit. Have they been given notice yet?

This is the landlords issue. They either pay your fees or lose your sale, they’ll still be getting the rent whilst you fork out £000’s. Ask your solicitor to arrange this and be prepared to walk away. This isn’t your fight with the tenants

Why on earth are you offering them money?

The house was for sale, I looked, it didn't have tenants in but they had just signed to rent that week. Owner said he is desperate to sell and earliest will be in 6 months when tenancy is up. If I love the house, why would I not go for it, it would still be for sale and someone else would have gone for it. The renters would have been in the same position.

Your anger is misplaced. The sellers should have waited until the house was vacant to sell, but they wanted their rent and their sale proceeds. The tenants have probably been told to stay put until they are evicted otherwise they can’t apply for social housing. You may LOVE the house but the tenants probably do to and are being forced from their home because their landlord wanted to sell. Also I am fed up of people whining about the stamp duty holiday deadline, it was a nice perk, you missed out. That’s how it goes sometimes.

It isn’t your problem, it is the vendors problem.

I would tell the vendor they need to deal with it or you will be pulling out.

Remember that your issue is with your seller, not the tenants. The seller should have waited until the property was vacant, but such sellers are often too greedy to forego even a brief period without rent.

I would give the seller a date to get it sorted by, and if that passes then I'd pull out. Sound more hassle than its worth.

If they haven’t got anywhere to go then what can they do? Unfortunately if you can’t afford to wait for it to resolve then go for a house without current tenants.

Honestly it's really hard to find somewhere to rent at the moment. I spoke to a lady at work who cant even view somewhere to rent because her partners furloughed and unless they can cough up 6 months rent up front they wont even let them view it.

Not with a residential mortgage, no. That’s before you get into gas and electricity safety, insurance, tax........

Pull out. Round the corner will be a better house you love more. The landlord should've waited until the house was vacant before trying to sell rather than pull the rug on his tenant's home.

If they haven’t found somewhere where do you expect them to go?
Throwing money at them won’t help.
It’s not their fault the court process has been lengthened.
Without anywhere to go they are screwed as they made themselves homeless.
You also don’t know their financial situation and a lot of LL won’t accept any type of benefit.

Pull out, look around to see what else is on the market but keep an eye on the situation. Who knows in a few months they may have found something and you save.

If you love the house enough to take the financial hit, then do so. If not, pull out.

You could ask the seller if they would accept a reduction in the price to the value of the money you’ll lose. Since they can’t offer vacant possession they can’t really expect you to pay full price. If they won’t reduce the price, you have the option of walking away. That might concentrate their minds.

If he was desperate to sell then he really shouldn't have just signed up renters.
It sounds like you were fully aware of the situation and knew youd have to wait at least 6 months to move.
Looks like you need to either pull out or accept you're in for a long and costly battle until they move out.

Honestly Wirlds Just pull out. Property should be sold with vacant possession - it certainly shouldn't be costing you time, money or hassle.

Whispers I'm hearing from estate agents is that it's likely stamp duty holiday will be extended which would be great, but even so, it's notoriously difficult to get sitting tenants out.
I know it's difficult - but you should avoid fulling in love with a house UNTIL someone hands over the front door keys - it's just not worth the heart ache. You have children to provide a home for, you can't afford to be sentimental.

Go back to your solicitor and tell them you want vacant possession in time to qualify for the stamp duty holiday or the deal's off. Surprised to be honest your solicitor hasn't said this to you already
