WIBU to call EA regarding another property?

It looks like the sellers don't have the relevant completion certificate(s) for a massive extension carried out on the property just under 2 years ago. We were purchasing but all I keep hearing is indemnity to which I keep responding with the request for retrospective building control sign off. It's been a few weeks and now I've given them the deadline until Monday to either produce the relevant docs or supply evidence that they've requested building control to sign it off otherwise we pull out.

Tbh, at this stage I'm just angry because it seems like they've probably known about this all along. I'm wondering if the EA had any obligation to check this but that's besides the point of this AIBU.

We need to move within the next couple of months and more urgently apply for a school place due by next Friday. I've just resigned myself to start looking at other properties for when they say they don't have the docs/delay/won't apply for retrospective sign off.

WIBU to contact the original estate agents to see if we can start viewing other properties over the weekend? Also, if you were the seller would you just throw in the towel at the news we'd already started looking 'just in case'?

Definitely start looking.

I say that as someone who was where your buyers are - if you buy based on indemnity insurance (as I foolishly did) you will end up with an unsaleable house. Buy somewhere without strings attached.

Definitely. If that doesn't make them get retrospective permission, nothing will.
Plus don't limit yourself to original EA. They do share details of viewers who are already in buying processes though, which may help get the message across to the sellers, or it may make it hard to be considered serious buyers on another property, unless you pull out first.

Thanks for your replies, I can hope they prove me wrong but at this stage it isn't a ploy and I won't hold my breath. At first I was really surprised that they didn't have everything in order to make this as effortless as possible but I think I missed the red flag when they said they wanted a quick sale and I think they'll just see this as being my fault for not accepting the indemnity.

Have you phoned the relevant building control department? I would have thought if you give them the property address nd explain you’re buying it but haven’t seen a signoff, is it in orogress and if not why... They can be quite informative.

I would start viewing other properties for sure, it will make the estate agent push harder for answers when they see that this commission might not work out...
