Am I going to be fined for this? (school related)

DD is 6, year 2.

Her attendance this term is 78%. She had 4 days off for isolation due to symptoms and awaiting test results in September, then had an operation a few weeks ago so has missed 12 days due to that. She has also missed a couple of half days due to medical treatment for other conditions.

I have evidence of all of this that DD has basically been off more than she’s been in this term.

The letter says we’re being referred to Education Welfare. The lady in the office at school says she’s sent all of the evidence along with the referral so I might just get a phone call to warn me to keep her attendance up above 90% next term (sometimes it’s impossible). But I’m worrying I’m going to get fined and worse still my ExH who I left due to violence and his control will also get a fine as he has PR and then I’ll lose DD because of it.

Am I likely to get fined?

We have had attendance as low as 58%, this term was good at 90.22% but have never had anything from educational welfare.

As it’s all been for good reason then it shouldn’t be a problem at all.

It's a bit of both for us as we had to isolate before the operation in order to be admitted to hospital which because it wasn't due to symptoms apparently goes down as authorized for medical reasons (I've just spoken to the school secretary who monitors of attendence among other things) but the initial isolation in September goes down as code X.

The time in hospital goes down as inpatient care code and is authorized as well (4 days). Her recovery from the operation goes down as authorised for medical reasons but on a different code to the isolation. Then this last week as the consultant only signed 2 weeks off goes down as educated offsite.as I agreed to home school for this week as she's not really well enough for school and for 1 week it wasn't worth the paperwork headache for school (HT said it would be a lot of paperwork as she needs a risk assessment and I just said it wasn't worth the headache for a week and HT agreed and said she'd be educated offsite as long as I keep up with education related tasks which I have).

So thats why it gets referred to EW because she's had 3 or more seperate periods of authorised absense this year, as well a couple of half days that have gone down as Educated Offsite.

I had a similar argument with my DS school. His attendance was down to 50% because he was I'll for the whole of the second week of term.

It's all to do with the calculation that they use to work out the percentage. They use the time off as a percentage of the days of school that have elapsed, and not the time off as a percentage of the whole school year.
As It was DS suffered no further illness that year and his attendance (expressed as a percentage) started to climb as the weeks passed.

The 4 days isolation does not count and has to be coded differently; provided you have medical evidence that says they couldn't attend school about the op you won't be fined

Yeah I have the discharge letter which has the consultants signature on that says "2 weeks off of work/education following this procedure"
