to expect ex-h to actually pay the rent?

Divorced 12 years ago, lived in marital home until 5 years ago, then re-married and moved out.
I let ex-h have house. He never helped with child support and in fact, rarely pais the bills when we were married. Property is shared ownership, 25% mortgaged, 75% rented from LA.

Mortgage was in arrears, rent was in arrears, council tax in arrears.

Ex-h taken to court by Bld Society and court order for 6 months to make him pay mortgage and some off the arrears.
But,
this doesn't cover the rented part! So ex-h refuses to pay the rent, as "It goes on the mortgage, so why should I?"

Mortgage is now £5k in arrears and the Bldg society wont do anything about it as it is not covered by court order.
As my name is still on property, I am liable for the rent and if the house were sold today, I would be liable for approx £10k debt!, even though mortgage is 20 years old.

WTF is going on?

ex-h unable to comment as he is on holiday (lucky him!)

You need to take your name off the tenancy agreement, and I would take it off the mortgasge and force sale if I were you - you would then get half the proceeds of the house I think, and could pay the 10 grand back out of that.

You ex sounds like a childish twat

The £10 is because there will be no proceeds, just debts, including CCJ's for loans which I signed jointly with him, when we were first married, to help him out of trouble [mug emoticon]

My DH did a spreadsheet for me and with all the costs of sale etc, the house would have to increase in value by £70k to break even!

do you have proof of addresses for the last five years? was your exh resident during those five years?

I'd contact a lawyer and say that your exh said that he had changed all the paperwork and that you didn't have to sign anything. you may look a bit daft, but it may help with the liability. take your proofs of address and divorce papers with you. surely divorce should end the joint liability?

I don't think divorce ends joint liability if the agreement was signed before the divorce.

Ex-h wont agree to sale and DS1 & 2 (DS2 lives in the house) don't want me to lose my share, because "Dad will just not pay and then lose their inheritance"

EX-h was 'unregistered' from 1995 to 2002 for everything, including tax

He is now on the electoral roll, but denies that he is him, IYSWIM

He never changed his driving licence from the marital address and used this for proof of ID.

Fines for speeding and no tax sent to my address.

The list goes on........
