Neighbouring treehouse

I will append a diagram if it helps, but AIBU to ask neighbouring family to take down large wooden treehouse that sits above the level of our fence and dominates the view?
I don’t know the neighbours and don’t want to start a dispute with them, especially as we only recently moved in. However, we had no idea there was a treehouse overlooking our garden. It was disguised by overgrowing trees as the previous owner of our house had passed away over a year before we viewed the house...and the trees hadn’t been cut back for a while. After a few days living here we started to see heads of small boys popping through the trees about 4 feet above our fence. I still didn’t realise it was a treehouse. Then a month later they employed a tree surgeon to cut back the trees as they were overhanging our (small) garden and blocking light from getting in. This exposed the entire, very large, wooden treehouse. It is a platform about 5.5ft off the ground, with a see-through fence panel about another 3 ft in height around its edge. The whole structure sits above the level of our fence. It has some bits of camouflage netting and a sheet of canvas loosely attached, that flap and wave in the wind. It is both intrusive and unsightly and I have no idea what to do about it without angering the neighbours. I have had advice from the council who said they will happily go round and investigate anonymously whether they should have sought planning permission for it, but it would be completely obvious that we instigated it, as it doesn’t really affect anyone else. I know that if/when we decide to sell our house this treehouse will put a lot of people off. It dominates our very small garden.

Has anyone managed to resolve a similar issue without it leading to a dispute?

@HeronLanyon

Yes, a planning officer checked and said they never applied.

Thanks everyone. I think I've had enough advice and it has (for the most part) been very helpful. I will stop replying now for fear of annoying the few who are easily angered by my slowness to act. Yes, I will call round, but I hate confrontation and need to gear myself up a bit first, and it is STILL lockdown, supposedly.

A buddleia will grow massive quickly. Or eucalyptus. Also massive. They both grow about 6 foot a year

spooked7 Wishing you a smooth understanding discussion with the offendr and immediate action taken to remove it and leave it better for you.

PanamaPattie · 15/11/2020 23:04

Good luck.

StoneofDestiny · 15/11/2020 23:16

Your position is easier now - you can tell them you have contacted the planning authority about extending your fence to protect your privacy/hide their treehouse and it's brought up the fact they don't have planning permission for it. Shifts the 'bad hat' to the planning dept!

lalafafa · 16/11/2020 00:16

What a pain for you, hope you get it sorted

Newwayofthinking · 16/11/2020 08:40

Good luck, let us know how you get on

Aridane · 17/11/2020 18:36

@osprey24

could you fix a sail like structure to your bottom fence to screen them off?
🤣
PeachyPeachTrees · 18/11/2020 22:12

Loads of people all over the country built tree houses, climbing frames etc to keep their kids occupied during lockdown and summer hols. 6 long months of having kids off school and mainly at home brought this on. The structure looks new and as op's house was empty and the trees tall, no one noticed or objected.
It highly likely it wasn't there when op viewed the house. It is too high, too near her garden and she is rightfully upset.
I hope you get it sorted and by sorted, get it removed or fully screened off by them at their cost.

Sparticuscaticus · 19/11/2020 18:36

I have checked in to see if any update

I think that you've been very understanding snd totes get why you'd want to take a conciliatory approach. It won't achieve hat you want though as you'll end

What I posted a few days ago still stands , it's not an Afro response but please trust that the council workers that you don't have much faith in, actually may be good at their jobs,

And they may be the best people to deal with this in the most clear way

You are otherwise muddying the water
You can't live with that level of intrusion into your garden and back of your house
So please let the experts deal with it
Planning dept
It's a new structure
It interferes in your privacy

Everything else is irrelevant

Sparticuscaticus · 19/11/2020 18:38

Argh
Typing fail snd I forget to finish a sentence

It's not aggro to go to planning dept/council

Earlier paragraph was meant to say ..or you'll end up conceding too much in a way you won't be happy with

custardbear · 21/11/2020 10:39

@Spooked7 - any luck with your neighbour?

Hawkins001 · 21/11/2020 11:43

Any current updates ?

DreamTheMoors · 30/11/2020 05:48

@WhatATimeToBeAlive

That would piss me off too. Maybe plant some Leylandi to block it off!
My thoughts exactly, @WhatATimeToBeAlive.

Also called Leyland Cypress. Really fast growing & not bad looking. Inexpensive too. A simple solution for everyone & no drama. A couple would be plenty. Maybe too much.

blisstwins · 30/11/2020 06:17

bamboo

sparticuscaticus · 02/12/2020 20:59

Gosh it's ridiculous people are suggesting OP grows invasive bush or climbers

It's an illegal structure that requires planning permission
The right thing to do is ask planning dept in Local authority to deal with it
Why is everyone so scared of that? They are there for a reason, it's their job to stop this kind of thing . They have powers and are very nice people!!
