Neighbour extension

Hi

So my neighbour who has been very difficult ever since we moved here. So no chance of speaking to her. Anyway we all have an extension at the back. She has now added 2.5m extra to her extension, it's attached to her extension but not really part of the house as it's not closed off with a door. Think of an outhouse attached to the house but no door. I want to know would she have needed permission for that, would neighbours have to have given approval? Obviously we got no such thing from the council. My issue is in the summer, it will cast a huge shadow in the area we sit in. Its on our partition wall.

If she's already got an extension wouldn't this new one take her over permitted development?

Couldn't get through to the council. Have emailed them and awaiting a response.

If it's a lean-to or like a bus shelter on the back of her house its probably not classed as a permanent structure so I doubt she'd need planning permission.

Depending on how it's done it may take her over permitted development.

I've also read things in the news about sheds, summer houses and lean tos sometimes requiring permission depending on size and location.

Could you also look into the 45 degree rule? I'm not sure on the technicalities, but it's something I've read about on here and seen on property shows but it affects what some people can do at the back regarding light and windows etc.

Have you checked online for any pp or prior approval submission. The neighbour notification is not reliable, especially at the moment. If the additional part has no internal access to the property it may not have needed permission and fall within "shed" rules.

Can you do a diagram, possibly as if you are looking from the back of your gardens towards the back of the 2 properties

Maybe check on your council website if there's any detail about what kind of structures need planning permission. Ours has quite a bit of help pages. They might answer your queries and then you are armed with information if the council do get back to you.

Permitted development allows a certain number of metres from the house and that varies if it's detached, semi or terraced. I think it's 5m typically.

Have a look at the planning portal. It gives good advice on permitted development rights.

This is a permanent structure that you are describing. If it is attached to the house (door or not) it would be classed as an extension.

Permitted development rights have significantly changed recently, and will change even more so over the next year or so (first floor extensions may no longer require permission).

The 45 degree rule is only applicable if permission is required and the local council apply it (not all do). If it is permitted the overshadowing is irrelevant, if not it would depend on how big your garden is, it would unlikely be a single reason for refusal though.

Best bet is to get through to planning enforcement who are the most experienced when dealing with of rights.

Next door but one to me did this, it was sort of a lean-to/veranda type structure. Didn’t even have sides, just a plastic roof! They didn’t have the decency to tell their neighbours they were doing it.

Anyway, the house between us reported to the council as no permission sought or party wall agreement made. Council did a visit & issued notice for them to remove it...then covid hit. They haven't been back to check & it’s still there in all it’s ugly glory!

Permitted development is 3m without neighbour consultation on a semi and 4m on a detache (Single storey). I’m not sure how the original extension affects this though.
