Is this GDPR breach?

This involves a dental surgery a whole family has used for 40 years

If your father had the same dentist as you, and he asked the receptionist when your last appointment was, would the dental practice be in breach of GDPR legislation by giving your father the details?

You don’t live with your father. He is in his 60’s, you are in your 40’s and not lived at the same address for 26 years

Yes but ico won't do anything but "make recommendations"

Are you sure it wasn't a vague question. Dad to dentist "have you seen our Jane recently, dentist gosh not for a few years now"

Betty94 · 05/11/2020 09:15

The thing is if he called and said "my name is starburst24, my address is blah blah and my DOB is blah blah" then there's not much the dentist can do if he's passed all the data protection questions over the phone.

Don't 'go ballistic', you're not 12, you can deal with your emotions. Raise your issue in a reasonable, calm and assertive way.

Agree with @Henners7. Going crazy at the receptionist isn't going to help things. Speak to management and further training will be given, the receptionist will get a telling off and will feel bad enough about it.

Don't go mad at the receptionist, go mad at the practice manager who has clearly not trained their staff in the actual law. I hate this attitude of "don't make a fuss, don't upset someone".

Don't go mad. Just let the practice manager know. There is a flip side to this I work in a similar setting and sometimes we'll get (for example) a phone call from elderly Mr A asking if Mrs A has seen the doctor yet as he's waiting for her in Tesco and it's been a long time. When our staff say they can't even confirm if Mrs A is a patient, let alone if she's been seen we'll get a "don't be ridiculous I dropped her off, why can't you tell me"! Exasperated patients in both cases and the receptionist gets an ear bashing.
Find out the circumstances first but it seems as if staff may need updated training.
