Hate crime bill: Hate talk in homes ‘must be prosecuted’

AIBU to think this is very concerning? One person's hate speech is another person's free speech. There has already been a LOT of worry about the potential implications of Scotland's proposed hate speech law, but this is the first time I've seen suggestions that even conversations in private homes are going to be monitored in some way.

Are they planning to encourage children to report on their parents?

It also concerns literature. Here's another article on it. I think everyone needs to fight this. Some people think it's just to tackle radicalisation (which gets their support) , but it goes way beyond tackling a specific issue.

It's the way it's going in Scotland. I'm a Scots legal academic and its becoming impossible to get published in Scotland if you critic use the government. My university makes me submit academic articles for "approval" to the Principal before I'm allowed to submit them for publication, in a way which wkukfnt be allowed in The Netherlands, Germany, etc..

The media in Scotland is very poor at holding the Scottish government to account. The Parliament is unicameral - it's decisions are reviewed only by committees comprised of its own members. The checks and balances in the UK Constitution simply aren't part of devolved government.

This legislation would probably be successfully challenged under the EU Charter on Fundamental Rights (a bit like minimum alcohol pricing and named persons legislation were) but we are coming out of the EU and the enhanced human (fundamental) rights will no longer apply.

Renemver the Scottish government's last attempt to legislate in people's own home lives - every child born in Scotland was to gave a state appointed guardian who could overrule the parents. That died a death, not least because one of the state guardians appointed in the pilot study in Nairn ended up being convicted for having indecent images!

It's certainly interesting and easier to do now than ever before. If you have an 'Alexa' or 'Siri' device switched on then any conversations it picks up is recorded and archived at Amazon/Apple HQ. Not sure about accessibility or how it would stand up in a court of law though.

I should also add that all the categories of civil discrimination are included in the hate crime bill - except sex. So in the Scotland of the future, you will continue to be as verbally abusive about a ierson as you wish, if your verbal abuse relates to male or female characteristics, but not transgender people, because that is protected.

I probably wouldn't even risk making the above statement in the Scotland of the future, as its just not worth the risk of being investigated. Goodness knows how we will write about discrimination law, as it will be too risky to include references to past laws and cases.

People needs to think very carefully and research before they vote in the elections and the consequences.This is only going to get worse.

Would Shakespeare's plays be allowed under this legislation? I can think of multiple points which would fall foul of the charge of inciting religious or racial intolerance or xenophobia (although of course insulting & inciting hatred of women is still ok!)

This is part of the SNP's nutty agenda and no, it is not going to replicated in England and Wales. If the SNP think this makes them more progressive than "Westminster" I'm sad for Scottish people but bloody glad it won't be here.
