To ask my employer for compensation for accidentally leaking my pay details?

Posting here for traffic. I'm part of a group of people being made redundant at the end of this month. As part of the process, every individual in this group has been emailed a financial illustration of what the package will look like. It's a 1 like excel spreadsheet with detailed personal information including gross annual pay and a full breakdown of the exit package.

We have just found out that on one person's spreadsheet, along with that person's financial information, HR accidentally shared all the information for 6 other people! I am one of those people whose information was shared and I'm so upset! This is a breach of confidentiality and data protection surely!

Will I be unreasonable to claim compensation for this?

I doubt you’d be successful if you’ve had no losses.

Batshittery · 27/10/2020 20:10

I don't see that it's a compensation issue tbh. Presumably you'd still be upset? Most people's pay can be found out these days. It's not exactly top secret

spanieleyes · 27/10/2020 20:10

Compensation for what?

Pepperwand · 27/10/2020 20:11

You can always try, but I agree that you would probably be unsuccessful.

Iamthewombat · 27/10/2020 20:12

I’m with @TeaStory. What loss do you need to be compensated for as a result of your salary being shared?

There will be quite a few people with access to your salary details. You may not want people to know it, but it isn’t necessarily a secret.

salviapurplerain · 27/10/2020 20:12

@spanieleyes

Compensation for what?
For breach of confidentiality

YABU and greedy

I think you could report to information commissioner as it is a data breach. They should actually do this anyway given what has happened.

There may be an investigation and recommendations given, possibly a fine for them and so on. I doubt you would get financial compensation though. I also don’t think it is warranted- an apology, changes made etc, absolutely, but it sounds like you are just chasing the cash rather than anything else. How much do you think they should pay you?

fuckfuckingcovid19 · 27/10/2020 20:14

You haven't lost anything though so what would they be compensating for?

Complain, sure and they should apologise but you've not suffered any loss here.

user183684257424 · 27/10/2020 20:17

They could be fined for the data breach.

I don't see any basis for compensation to be paid to you; you haven't suffered any financial loss.

TeaStory · 27/10/2020 20:18

That’s not how it works. No loss, no compensation.

oblada · 27/10/2020 20:19

You've not lost anything and the confidential status of the information leaked is questionable to be honest. In some companies pay information isn't treated as confidential info. You can report it to te ICO if you feel strongly about though I dont expect your employer to be fine. Mistakes happen!!
It's sad that we are in a society where every little mistake leads someone to ask for financial compensation. Madness. I expect you've never made any mistake? At least your employer can now be glad to see the back of you.

oblada · 27/10/2020 20:20

'Fined'

Babyg1995 · 27/10/2020 20:21

ConfusedConfusedConfused no you can't claim compensation for that .

myusernamewastakenbyme · 27/10/2020 20:23

Lol at this thread not going in the way the Op was hoping.

MonClareDevole · 27/10/2020 20:25

YABU. It was personal details accidentally shared within the company. If you’ve suffered financial loss from this, go ahead and ask for them to be compensated. But I doubt you have.

rottiemum88 · 27/10/2020 20:25

FGS, is this honestly the way some people think? 🤦🏼‍♀️

I work in data protection and (unfortunately) see breaches much worse than this occurring most days of the week. Yes, it’s a data breach. You could choose to report your employer to the ICO. Nothing is likely to happen if you do. You definitely won’t be compensated. HTH

salviapurplerain · 27/10/2020 20:31

Thank you all for your responses. Some might feel it's being greedy and I can see why you would think that. Posting here to me is about trying to get information from people and fill in gaps for what I can't find on google. I just wanted to know if I have a case or not and NO can be the answer to that question

YABU and greedy
Straight to the point. Love it Grin
Crazycrazylady · 27/10/2020 20:33

Sorry Op. you've suffered no financial loss. Report them to the Gdpr people if you like but sounds like it was a honest HR mistake as opposed to a systemic issue so I'm not sure you'll get very far there either.

2kool4skool · 27/10/2020 20:33

NO

Sparklesocks · 27/10/2020 20:35

You could report it as a data breach but I don’t see how any outcome would result in cash for you I’m afraid.

Brighterthansunflowers · 27/10/2020 20:36

YABU

you’ve suffered no financial loss for them to compensate for! It just sounds grabby you want money for a mistake

Meowza74 · 27/10/2020 20:41

There's nothing to compensate you for as you've suffered no monetary loss.

Georgeoftheinternet · 27/10/2020 20:48

It’s not a data breech
