To think she owes me another perfume?

Colleague at work has started selling perfumes that smell like big names but don't have the packaging. They're lovely and I was really pleased with the samples.

I ordered a favourite of mine and was told it would be with me within the week. Fine. That's great. Wasn't fussed even if it took a few weeks for the price.

Anyway, I had to self isolate for 10 days because of DC. I returned to work yesterday to discover no perfume so knocked and asked if it would be soon, I was excited to try it etc. She said ''Oh, I left it on your desk Monday?''

I said there's nothing there... She said someone must've moved it then or taken it. I asked why she didn't keep it with her until I got back? She said ''Your office is usually locked isn't it? I thought you were back because it was open'' to which I replied no it isn't, because its shared all the time with another colleague! A very laid back man with a very kind way about him. There's no way he's taken it, I would've thought.

AIBU to want another perfume? Before I left she said she would ask around to see if anyone's seen t and that I should do the same Confused

Ask your colleague if he's seen it? He may have put it somewhere safe.

I think asking around is a very good idea, and to be honest I'm a bit torn whether she should give you a replacement.

She thought your door was locked so it's a genuine mistake, but then if it was me, I'd be making sure to give you the perfume in person and I'd automatically offer you another if after asking around no one had seen it.

She could also be fibbing I suppose!

She has worked across from us for a long time. There's no way she can't know who else sits in there.

My colleague in the same office space hasn't taken it, I wouldn't imagine at all. For a bit of background, he's incredibly generous and constantly bringing 'treats'. Couldn't do enough for anyone. Made sure I was completely covered last year when I went through a grieving process that was very hard. He just wouldn't do it

You need to make a complaint to HR because there’s a thief around. Also this woman needs to be prevented from selling perfume at work. She shouldn’t be doing it anyway, but if she’s not giving people the goods they’ve ordered she needs to stop because she’s creating trouble. And yes, she owes you either the perfume or your money back. Tell her it’s not your problem what she’s done with the perfume, she either needs to produce it or refund you.

Hmmm. Is she the type to lie? I’d probably ask around a bit, then let it go if the mystery isn’t solved. If you order from her again, ask her to make sure she gives it to you personally to avoid this odd scenario.

I think if anyone wants to sell stuff they need to ensure it is delivered into the hands of the buyer, unless specifically agreed otherwise. She should have kept it until she saw you, she definitely owes you a perfume.

I’d be a bit more professional and not get involved in knock off MLM products being delivered to your desk.

Maybe I'm cynical but I dont think she ever put anything there- seen an opportunity to pocket the money.

She shouldn't have just left it on your desk, she should have given it to you personally.

Insist.

She would be daft to get work involved or push you into getting them
Involved as they might tell her she's not allowed to sell stuff while at work

The seller is responsible for delivery. If she sold it to you and posted it, and royal mail lost it, she would have to replace or refund you and then claim from royal mail. Here she chose to use insecure delivery methods. The onus is on her to refund or replace.

100% agree with this.

No one saw her leave it and no one saw the perfume on your desk. Sorry Op but I don't think she actually left it on your desk at all

Well she shouldn’t have left it on your desk but if she thought you were back I can understand why she did it.

Could a cleaner have moved it/taken it? One of our office cleaners is lovely but overzealous about tidying, dusting, sanitising. A lot of my stuff turns up in weird places eg other people’s drawers or stationary boxes as she moves it to clean. I once lost a document only to find it in a box under my desk a week later!

Thank you. I will be demanding a refund then if I go to her today, explain I've asked around and its not appeared

Additionally though I don't think it should be my job to ask around. It should be hers

Also she should remember I wasn't there due to the many emails I got from her whilst away. They would've all contained my out of office stating when I'm due back

Tell her , you would like her to come with you to HR and report that there is a thief in your offices.
This needs to be done.
Also you need a replacement or refund as you have not received your goods.

If I was in HR I'd be steering well clear- and advising staff not to be selling and buying knock offs at work. Its up to you to sort- not your employer. If you genuinely believe that something has been stolen from your desk then that needs to be raised as a concern- but HR won't make her refund you

Technically she does owe you another perfume or a refund as it's the responsibility of the seller until its received by the buyer.

I'd ask nicely for replacement, not demand. Remember although it's her legal responsibility, if she has put it on your desk, she will be out of pocket organising another one for free. I'm not sure if its worth falling out with someone you've got to work with going forward, over.

I also wouldn't involve HR, I'm not sure either of you are meant to be arranging to buy and sell stuff in the office in work time.

She has not yet delivered you the goods that you paid for, leaving the goods unattended doesn't count. If someone had broken into her house the night before and stolen the item you were buying, would she consider that to have been not her problem, and expected you to swallow the loss? Of course not. She effectively lost the item before handing it over to you. It is her responsibility to replace it.

I agree HR should ban MLM selling between colleagues in the workplace though.

If your office is locked then how did she get in to leave it there?

As pp said it’s an MLM so unless it was £££ I’d write it off and not go near buying anything from her again.
