To consider claiming tax relief for a property

I have a buy to let that I lose money on each month. Unfortunately it’s in negative equity, so I can’t sell it.

I have never made a profit in a year above £1,000, which is tax free, so I’ve never declared the property.

Should I claim tax back? Have I been paying too much?

The way this is framed is a little odd.
If there is a relief you are entitled to, you would of course not be unreasonable to claim it.
If you're just annoyed that a financial investment is less profitable than you'd hoped and think you deserve to be compensated for that with a lower tax bill, then you would be unreasonable.

It depends how much tax you've been paying and what sort of tax it is.

I don't believe it's possible to offset self-employed or business losses against PAYE income, for example, but it may well be possible to offset it against self-employed income, simply by including it in your tax return.

However, if the loss on the property arises because the rental income is lower than the mortgage repayments, the rules regarding mortgage interest on rented properties have changed in the last couple of years, so you'd need to check if there's still a loss when you apply the new rules.

There's isn't any tax to reclaim is there? Profit on property is in a different tax band from paye/self employment so you couldn't reclaim tax paid on that income.
The loss can be carried over between tax years though and I have a vague idea it can lower capital gains tax liability, but will definitely be useful against future tax liability when you do start making a profit....
But don't take my advice as gospel, I'm about as far from an accountant as it's possible to be.
