neighbour's cameras filming our houses!

Annie1919 · 07/09/2020 20:27

My next door neighbour came over this morning to let us know that the 'odd' family opposite have put two large night vision cameras in their kitchen and bedroom windows (at front of their house), pointing straight at/into both of our houses! This afternoon, said next door neighbour went across to speak to them about the cameras and to insist that they remove them from filming through our windows- they refused to open the door to speak to her- even though she saw them in their kitchen as she walked over! Tomorrow I am going to try to speak to them. What would you do in this situation? and does anyone know what the law says? Thanks.

The law is different in different places. Are you in England?

Longdistance · 07/09/2020 22:03

In England I believe the camera is not supposed to be filming another persons house or land. It is only supposed to be for personal use ie, front garden/back garden/drive.
We have cctv on our house and it covers the back garden. The front cctv covers our driveway, front garden and the road up our private road (with full agreement from the neighbours) as this covers every vehicle coming and leaving our close.

This can help you if you’re in the UK. Additionally, I know that theres been recent case law on voyerism, making it illegal. If they’re recording into your bedroom, you may have a case with that

Not sure what the law is in the UK but every time we leave the house we're being filmed multiple times. Maybe having a camera trained on your house is under some sort of law, I'm not sure. Google will no doubt help you

I have three exterior cameras and the one on the rear of the house also has some of my neighbour's garden in the frame. If I want to film my garden I will have either my the neighbour to the left or the neighbour to the right in the frame because it's quite a wide angle lense. My neighbour to the right has cameras, we may well be in his frame, I don't know

Not sure why somebody would buy cameras and then film neighbours. Without seeing recordings you'll never know exactly what they're trained on. They might just appear to be on your houses but actually aren't

TheSeedsOfADream · 07/09/2020 22:07

Lots of recent threads about this. You can ask the neighbour to show you what their actual screen view is, and they can block off the bit showing your house.
Do you live opposite with a road between? Because presumably they are filming entrances to their own property for security purposes.

Thanks everyone. Their cameras are pointing directly at my bedroom and living room windows atm. They were previously pointing at my next door neighbour's young daughter's bedrooms. They don't seem to be covering their own property.

My sister had his with her suitcase neighbour. The police (who were called about his threatening behaviour) told her that she is entitled to demand to see the footage.
This is from the gov.uk website
^ If your CCTV system captures images of people outside the boundary of your private domestic property – for example, from neighbours’ homes or gardens, shared spaces, or from public areas – then theGDPR and the DPAwill apply to you. You will need to ensure your use of CCTV complies with these laws. If you do not comply with your data protection obligations you may be subject to appropriateregulatory actionby the ICO, as well as potential legal action by affected individuals.

The ICO has publishedguidance on the use of domestic CCTVand aCCTV checklist, which will help you to better understand and meet your obligations under data protection law. It is important that you read this guidance as well as the checklist, as this is a fuller explanation of your obligations to data protection law. The ICO has also publishedguidance for people being filmed by domestic CCTV. ^

Creepy weirdos. I'd call the police.

Annie1919 · 08/09/2020 10:21

Safer neighbourhoods police are over there talking to them now. Fingers crossed it gets sorted.

How stressful! I'm glad the Police are talking to them. There's no reason to train cameras on a neighbour's bedroom Shock.
I'm intrigued by the 'odd family' comment and wonder what else has happened.

TheSeedsOfADream · 08/09/2020 10:37

Gosh, that was quick.
Maybe he is already known to the police.

ApolloandDaphne · 08/09/2020 11:36

Did someone report them?

billyt · 08/09/2020 14:17

If the neighbour has installed 'night vision' cameras as in infra-red inside his windows he's not going to see a lot Grin IR units will reflect back off of the glass!

TerribleCustomerCervix · 08/09/2020 14:21

Are they maybe dummy cameras as a means of deterring burglars, so they aren’t recording?

Very very weird behaviour regardless. Glad you and your neighbours have been on the ball getting the community police involved.

CustardySergeant · 08/09/2020 15:05

"My sister had his with her suitcase neighbour."

Is that a typo for nutcase?

Annie1919 · 08/09/2020 17:56

All sorted, upstairs camera removed and downstairs camera now angled towards their own drive. Apparently they are worried about their 5 cars (for 3 people)! The Community Police were great and very quick!

Watch out for them putting them back a few hours after the police have gone ....

We have three - one on our back garden, one on the alley between the houses (where a neighbour had a bike nicked, so she's happy with the arrangement) and one on the front to monitor our car as we have only road parking.

Felifox · 08/09/2020 18:12

One of my neighbours was flying a drone from his back garden. He didn't do it twice! Glad it appears to be sorted.
