My husband called the police on our neighbours last night

We are next to a HMO and the three early 20s living there have been pretty irresponsible since they moved in, and two weeks in a row they have had loud parties keeping my husband up (I am in the baby's room at the moment so don't hear them). He called the police at 5am. How would you have reacted? Ring the doorbell at 5am, ask them to turn it down, talked to them the next day? I am much more scared of conflict than he is and would probably have done nothing, but he just had enough. I was pretty shocked when he told me this morning. No point in contacting their landlord as the flat is owned by notorious Mark Fortune... sigh.

@PinkiOcelot not stupid question at all. HMO is an abbreviation for Home of Multiple Occupants. It means a flat which is let by 3 or more people who are not related i.e. not by a family. it is usually students or younger people

I don’t know the in and outs and I don’t know the correct terminology but I think HMO licensing can or does include Requirements for landlords to take reasonable steps to minimise antisocial behaviour of their tenants.

Maybe it’s worth checking with your local HMO licensing team.

In the meantime, document EVERYTHING. If possible get other neighbours to complain as well. A Complaint letter signed by a few of you will have far more weight than an individual complaint.

It doesn’t sound like the tenants are students but if they are contact their college or university.

Good for your husband, hopefully your other neighbours will be supportive in raising complaints too as this really helps getting it taken seriously.

my other half once had to ring police on the neighbours in our previous home.A mother locked her toddler outside alone not in their garden but outside a block of flats

Only thing to do if your neighbors are unruly ,you dont want things getting ugly

I feel for you, next door to me was an unlicensed HMO and one particular lot of stunts were practically nocturnal. We called the Council and it turned out the landlord wasn't registered. Although the Council couldn't prove there were 3+ unrelated people there, the landlord got a massive fine for failing to register and subsequent tenants have been OK. (Still no HMO licence as landlords are skinflints and don't want to do the fire upgrades etc.)

Do you know when the licence is due for renewal? Currently they need to re-apply every 3 years, the Council's HMO unit should be able to tell you. Records of anti-social behaviour could be a basis for refusing renewal but this wouldn't necessarily happen automatically and you (and hopefully other neighbours) may need to put in an objection to the Licensing Committee to avoid the renewal being rubber stamped.

I hate - absolutely fucking HATE - loud, shit neighbours. Mine has been on holiday all week and not having to listen to her fucking dog barking and her arguing with whoever she screams at down the phone has been absolute and utter bliss. Literal heaven. She's back any minute now and I'm already dreading the sight of it.

Inconsiderate, selfish cunts like that should all be dumped on an island together far away from decent, peaceful people. Absolute cunts the lot of them.

In Scotland landlords need to register and be a "fit and proper person".

Police have been all over this lately. Not just cos of covid but with people not going abroad they've been acting out at home- take a look at what happened to dartmoor and pity what Spain/Greece have to put up with usually.

Most landlords in Scotland must register with their Council to ensure that they are a fit and proper person to let property. It is the owner of the property who must apply. Private landlords in Scotland are legally required to apply for registration with their local authority. Operating as an unregistered landlord is a criminal offence. A registration number shows that a landlord is approved by the local authority to let property.

This is really useful information, thank you! We have only lived in Scotland for a year, so the legal side of this is all new to us.

Also, I am SO pleased that no one is saying that this is just one of those things you have to accept if you want to live in a big city

I'm familiar with the registers, but I wasn't clear how someone is banned. Has he been blacklisted from the Scottish register or prevented from registering?

No,I do not think he is black listed. There would need to be due process that was followed , and that has been described in previous post

He can reapply to join register at three yearly intervals

Totally right to call the police . We have problems with residents in the temporary flat. If its after 11pm and just music we call the anti-social behaviour team at the council. If its fighting/ things being smashed etc then the police are sent.
And before ppl say 11 is early it's the rules set by the council.

I always used to either shut up and put up, or go round myself and try to amicably sort it out. Once I had DC I completely changed my tune - these days if I can't just live with it I would call the police.

As a PP said, someone showing that level of incosideration is not likely to listen to you politely ask them to be quiet, and you have then opened the door to a whole world of trouble.
