Full time to part time- what happens to accrued holiday?

Sorry I am posting for traffic.

I was a full time employee up until 1st August. Our holiday calendar runs January to January.

I was on furlough from mid May to mid July (I was only furloughed because I was pregnant).

To avoid redundancy I dropped to part time to job share with another colleague.

My full time holiday allowance is 25 days of which I had used 4 before being furloughed.

My question is, what happens to those days of holiday which were not taken whilst still being a full time employee but furloughed? Am I entitled to the pay for those lost days?

My colleague who I job share with days he doesn’t want to ask about it as doesn’t want to cause a fuss so is happy to let it slide as he was on furlough since March and has only just come back. But quite frankly I feel a bit screwed over by the company I have worked for for the last 7 years and could use every penny I can get.

You need to count how many days you were entitled to until Aug and take away the 4 days taken. The rest is accrued and you are entitled to. You the need to work out your entitlement for the period Aug to Jan pro rata. The total of the two is what you'll be entitled to take.

Your entitled to Pro Rata’d holiday - full time up to 1st August and then part time after that pro rata’d again. You as cruel holidays as normal during furlough. Whether you want to take them it up to you...you are entitled to but could choose not to.

Also I calculate my holiday in hours (part time) so would be advisable going forward for you

So if I was to calculate what days I have accrued and not taken could I ask for the money for those holiday days?

I don't think you can ask for money in lieu of holiday unless your contract specifically allows for that.

I guess it depends on your organisation. Presumably they might be keen for you to do that as you'll have a fair amount of leave to take which will make a big dent in your presence now you are part time.

For calculations, I always find it best to work all leave out in hours rather than days (in fact in our organisation everyone's entitlement is in hours). That way you can work out exactly how many hours of leave you have remaining. Then you can decide what to do next.

Agreed with above, calculate full time leave owed into hours, and discuss with your line manager whether you can take all that time off current working pattern, or they pay a lump sum, also, to other poster your entitled to accrue leave during furlough, employer must honour that!

I dont think you can get paid for holidays that would take you under the statutory minimum for England. So part of the question about getting paid will depend on how much holiday you get, and if that rule has been waived for furloughed staff.

What a horrible situation, I'm sorry you have been made part time.
You can politely ask to be paid for the holiday but cannot expect the money. Would you do this in a normal year? You are entitled to take the accrued holiday at a mutually agreed time.
Do you work for a large or small company?
My boss is usually really good but just as our industry is starting to pick up we wouldn't be able to cope with all employees either demanding extra pay or all the holidays that have been built up being taken at once. It's all hands on deck with a positive attitude to keep the company going and quite frankly to keep everyone in a job. Obv all holidays will be honoured.
I think given the circumstances everyone needs to be flexible.

Yes you can ask for money instead of holiday - but they don't have to give it to you. Also look for clauses in your contract that force you to take holiday within a defined period or risk losing it. You really should be able to ask your employer these questions but I know it can feel a little delicate at the moment.

It's probably easiest to think of holidays in terms of hours. Prior to this work out how many hours holidays you've accrued and take the 4 days off that. That's what you have in the pot. Going forward you have 8% of time worked or whatever your holiday entitlement is. Part time holidays is in terms of hours not days if that makes sense. So if you take a week part time holidays it takes a week of part time hours out of the pot rather than a week of days. I think it's completely reasonable to ask your company what have you accrued so far and how do you accrue holidays part time and how do you take them. I'd imagine that will answer your question without having to get into money issues.

Unfortunately employers are not permitted to pay for statutory leave.

You may find you have taken more than 4 days due to bank and public holidays as most fall in the first 5 months of the year.

Thank you for that, my colleague & I weren't happy about losing some of our allowance but I couldn't find any info online.
