Aibu to give up on new rental flat

Help, hoping someone can give me advice.

I was evicted from a flat 18 months ago, I did not fall behind on rent etc, the landlord wanted to sell and I just couldn't afford to move out.

I ended up living on friends sofas. I have now saved for a deposit to get my own place. I've found a flat I want to go for.

Before starting checks they want one week holding deposit which I might lose if they find something adverse.

My credit history is OK, no ccjs etc.
But will this prior eviction show up, and if so is it pointless starting the checks.
I'm reluctant to tell the agent about it if it isn't necessary.

Yabu- yes they will see the prior eviction

Yanbu- they don't check for this so long as there is no adverse credit history

I do believe that when a letting agent carries out credit checks they can only access the public information such as CCJ'S, bankruptcy or other insolvency. Not defaults or arrears. Hope this helps.

Did this eviction go through court? Is there a formal legal record of it.

Also are they going to want references from previous landlords?

I suspect it will depend on how diligent the agents are.

As a landlord I would hope my agents' screening would highlight this issue.

Was it a no fault eviction? Or did you stop bending long after the exit date provided, and your landlord had no choice but to pursue eviction?

They can check her own credit history for free if worried. This is all that a landlord would have access to. Google "fee credit report"

Thanks for your replies.

There is no mention of anything relating to this on the credit history as there were no arrears and no recovery orders through the court.

The eviction itself did go to court and that is the process that ended in leaving the property.

For context, the reason for this path was advice from the council and Shelter to stay put until the court ordered date to leave as this was the only hope of being considered for council housing, having been made homeless by the eviction. Frustratingly, having been made homeless the council then said they couldn't help.

Hence now trying to find private rent accommodation.

My question is, if there is no record on the credit history, is there a record somewhere else that the tenant checks will reveal.
If I was a landlord I wouldnt want a tenant that had been previously evicted either so I do understand. My question is will they find out.

@Splinkyplonk no there is no register or database on which a landlord can see everyone who has ever been evicted. It won't appear in your credit searches, the landlord will never know if you've been evicted before. Why wouldn't the local authority help?

The main issue would be the reference. She can pretend she was still leaving with friends/family, but as a LL, this would raise alarm bells and would rather go with someone who can produce a recent reference.

You should have left the property when asked by the landlord.

I wouldn’t give a reference to someone who caused so much trouble and if I had to then I’d be honest about the hassle you caused.

Don't you have to give a previous landlord's reference?

Can they really keep your holding deposit if you don't complete? Isn't that separate from actual charges for credit checks, etc.?

And where will you live if you don't go through with this?

Yes other references are available so no need to give this landlord as a reference.

And as silly as it is, you are not required to leave a property when a landlord asks you to. That's why the law means the courts get involved, to protect the tenant during the process of eviction. I don't think it's a great system but people all over the country are told not to leave or they won't be considered for housing by the council. As it was, once made homeless, the council rejected the application anyway, despite long term mental health illness.

I don't know if they can keep the holding deposit, that's what I'm worried about.
If this place falls through it will be continued sofa surfing for an indefinite period.

@hatesomethinchangesomethin thanks for this, I was hoping this was the case. It was a London Borough so you really do need to be in dire straits to get support and I guess they decided the situation was not dire enough. Bit annoying to have been strung along by the case worker at the time but trying to focus on finding a way forward now.
