Hot weather - cruelty to dogs

If I saw an old beagle being dragged through Regents Park at noon on a 35 degree day and it was staggering and panting WIBU to say something to the owner?

I live in Connecticut. We just had a heat wave last week, with the temps from 90-99F. I walked my dogs at 8am and 8pm. I only saw one or two dogs out in the middle of the day. People kind of know to beat the heat, given that these temperatures are a given in summer.
