Noisy neighbour / selling house / telling buyers

Hello you wonderful bunch of people!

I would appreciate some advice on how to handle this situation.

We have lived on our road for five years. We have a gorgeous little house that is shared ownership and worth approximately £300,000. We own half of it. There are two of the shared ownership houses on the road and one shared ownership flat which is directly next to us and has adjoining walls.

The houses around us are worth £400,000 plus. It is a lovely area with fantastic schools and a real sense of community.

Our family has grown and we have two special-needs children and my husband recently needed to create a home office.We need to move house as this one is just too small for us sadly.

In November last year and a new neighbour arrived at the flat next door. It is a woman who lives on her own, sometimes her son comes to stay with her although mainly it is men visiting. A few weeks after she moved in there was an almighty domestic incident which resulted to shouts and threats to kill in the street at about three in the morning and several people in the road having to call the police, the male was removed.

She has made an effort to make the front of her flat nice And it really does look so much nicer than when she moved in. At the weekends as she doesn't have a garden she will sit with all of her windows open and there will be several people in the flat making lots of noise either with loud Music or just talking very loud, (if I wouldn't know better I suspect drugs definitely alcohol)

She is never a problem during the day and as our bedroom is on the top floor I don't hear her but my husband does if he stays up late.

Last night there were several cars coming and going to her flat throughout the night this kept my baby awake as his bedroom is at the front of the house. Lots of light noise but mainly voices still going on at 4 am.

We have complained to the housing association before Christmas About loud voices and music and to be fair this has reduced although it could be to do with lockdown.

We are now in the position where we are having people viewing the house. I couldn't live with myself if I didn't tell the people viewing the house about the neighbour next door especially if there are children moving here. Just to clarify she has never woken up my elder two although this may have something to do with them having special-needs and needing medication to help them to sleep.

What am I legally required to sell prospective buyers about the house and the neighbour? There has only ever been one antisocial incident (The domestic) But last night she was very noisy. I was awake with the baby for over three hours because of the cars coming and going (it's all recorded on our ring doorbell)

AIBU To write her a letter explaining that children share walls with her and she kept them awake last night?

AIBU To say to new buyers"The neighbours here are fantastic and it is a lovely road. The lady next door can be noisy at times but it's not constant"

Any help would be appreciated. We desperately need to move to enable the two elder children with special needs to have their own rooms.

What would you do!

You have to disclose any disputes on the Property Information Form. I'd class a complaint to the HA as a dispute.

Thankyou @MinnieMountain - this was done last year and it's been relatively quiet since then. Just wondering was last night a one-off party?!

A complaint to the housing association makes it a dispute I’m sure. You’ll need to ask your estate agent/solicitor

We had a 14 month stint living in a flat and it was hell. It resulted in a noise abatement order and vandalism to our cars because of that.
We disclosed everything on our property details but were able to state we felt it was personal as my then DH (now exH) was a policeman and the people we lived above were prolific criminals.
Had the people we bought it from been honest however, we'd never have bought the bloody flat!!!

I wouldn't over do it! Say you made one complaint to HA and the noise subsided.
